JUSTICE R.M.DOSHIT)<\/p>\n<p>\tThis<br \/>\npetition under Article 226 of the Constitution of India is filed by<br \/>\ntwo residents of Una town, District Junagadh to challenge the<br \/>\nresolution of the Una Municipality to shift the fish market and the<br \/>\nmutton market from their existing location.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr.Shankhesara has appeared for the petitioners. He has<br \/>\nsubmitted that pending this petition the petitioner no.2 Mamadbhai<br \/>\nIbrahimbhai has passed away on 30th November 2006. The<br \/>\nsurviving petitioner no.1 Sattarbhai Sulemanbhai has made affidavit<br \/>\ndeclaring his intention not to pursue the present writ petition. The<br \/>\naffidavit and the copy of the death certificate are produced by the<br \/>\nlearned advocate Mr.Shankhesara.\n<\/p>\n<p>\tIn<br \/>\nview of the aforesaid affidavit, learned advocate Mr.Shankhesara<br \/>\nseeks leave to withdraw this petition.\n<\/p>\n<p>\tLeave<br \/>\nis granted. Petition is disposed of as withdrawn.
