RAMACHANDRA MENON, J.\n           ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~\n                 W.P.(C).No. 9995 of 2010\n         ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~\n         Dated this the 24th day of March, 2010\n         ~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~~\n\n\n                      J U D G M E N T\n<\/pre>\n<p>     The petitioner had availed a &#8216;housing loan&#8217; to an extent<\/p>\n<p>of Rs.5 lakhs in the year 1999 from the respondent\/Kerala<\/p>\n<p>State Housing Board, but the repayment could not be<\/p>\n<p>effected on time, under which circumstance, the Board<\/p>\n<p>proceeded with further steps for realisation of the due<\/p>\n<p>amount, under the RR Act, which forms the subject matter of<\/p>\n<p>challenge in this Writ Petition.\n<\/p>\n<p>     2.   Heard the learned Standing Counsel for the<\/p>\n<p>respondent Board, as well as the learned Government<\/p>\n<p>Pleader for the 2nd respondent.\n<\/p>\n<p>     3. The learned counsel for the petitioner submits that,<\/p>\n<p>the petitioner is ready and willing to satisfy the entire<\/p>\n<p>outstanding liability and that the relief prayed for in the<\/p>\n<p>present Writ Petition is only to have the benefit of<\/p>\n<p>W.P.(C).No. 9995 of 2010<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>installments, to wipe off the entire arrears in a phased<\/p>\n<p>manner.\n<\/p>\n<p>      4.    The learned Standing Counsel for the respondent<\/p>\n<p>submits that, though this is the 3rd or 4th round of litigation<\/p>\n<p>being pursued by the petitioner, the respondents are ready<\/p>\n<p>and willing to give one more opportunity to the petitioner,<\/p>\n<p>provided, a substantial portion of the liability is cleared<\/p>\n<p>forthwith, so as to avail the benefit of installments.<\/p>\n<p>      5. In the above circumstances, this Court directs the<\/p>\n<p>petitioner to deposit an amount of Rs.5 lakhs (Rupees five<\/p>\n<p>lakhs only) on or before the 31st of March 2010 and the<\/p>\n<p>balance amount shall be satisfied by way of &#8216;5&#8217; equal<\/p>\n<p>monthly installments, the first of which shall be effected on<\/p>\n<p>or before the 30th of April 2010, to be followed by similar<\/p>\n<p>installments, to be effected by the 30th of the succeeding<\/p>\n<p>months. It is made clear that, if any default is made by the<\/p>\n<p>petitioner, the respondents will be free to proceed with<\/p>\n<p>W.P.(C).No. 9995 of 2010<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>appropriate steps to the realisation of the entire amount in<\/p>\n<p>a lump sum.\n<\/p>\n<p>      The writ petition is disposed of as above.<\/p>\n<p>                           P.R.
