Pheruman, Advocate\n                 for the petitioners.\n\n                 Mr. Abhishek Chautala, AAG Punjab.\n\n                 Mr. Vinod Arya, Advocate\n                 for respondents No.2 to 17.\n\nRAJESH BINDAL, J.\n<\/pre>\n<p>                            ****<\/p>\n<p>                 Prayer in the present petition is for quashing of FIR No. 45 dated<\/p>\n<p>11.4.2002 registered at Police Station Garhshankar District Hoshiarpur, under<\/p>\n<p>Sections 307, 506, 323, 148,149 IPC and all subsequent proceedings arising<\/p>\n<p>therefrom.\n<\/p>\n<p>                 Learned counsel for the petitioners submits that the dispute<\/p>\n<p>between the parties has been compromised with the intervention of the well<\/p>\n<p>wishers and keeping in view that peace and harmony is maintained in the<\/p>\n<p>neighbourhood. Reliance has been placed upon a five Judge Bench judgment<\/p>\n<p>of this Court in Kulwinder Singh versus State of Punjab 2007 (3) Law Herald<\/p>\n<p>(P&amp;H) 2225.\n<\/p>\n<p>                 Respondent no. 17-complainant, had appeared in Court in person<br \/>\nwho admitted the factum of compromise between the parties and stated that he<br \/>\nhas no objection in case FIR in question is quashed. Respondent no.2-<br \/>\nHarbhajan Singh, one of the injured also made a statement to that effect.\n<\/p>\n<p>                 Dealing with issue of quashing of FIR on the basis of compromise,<br \/>\na Bench consisting of five Hon&#8217;ble Judges of this Court in Kulwinder Singh&#8217;s<br \/>\ncase (supra) while approving minority view in <a href=\"\/doc\/1718829\/\">Dharambir v. State of Haryana,<\/a><br \/>\n2005(2) Law Herald (P&amp;H) (FB) 723, opined as under:-\n<\/p>\n<blockquote><p>                 &#8220;27.      To conclude, it can safely be said that there can never be<br \/>\n<span class=\"hidden_text\"> Criminal Misc. No.-M-28859 of 2008 (O&amp;M)                            2<\/span><\/p>\n<p>                           any hard and fast category which can be prescribed to<br \/>\n                           enable the Court to exercise its power under Section 482,<br \/>\n                           of the Cr.P.C. The only principle that can be laid down is<br \/>\n                           the one which has been incorporated in the Section itself,<br \/>\n                           i.e., &#8220;to prevent abuse of the process of any Court&#8221; or &#8220;to<br \/>\n                           secure the ends of justice&#8221;.\n<\/p><\/blockquote>\n<blockquote><p>                 28.       In Mrs. Shakuntala Sawhney Versus Mrs. Kaushalya<br \/>\n                           Sawhney and others, (1980) 1 S.C.C. 63, Hon&#8217;ble Krishna<br \/>\n                           Iyer, J. aptly summoned up the essence of compromise in<br \/>\n                           the following words:-\n<\/p><\/blockquote>\n<blockquote><p>                           &#8220;The finest hour of justice arrives propitiously when parties,<br \/>\n                           despite falling apart, bury the hatchet and weave a sense of<br \/>\n                           fellowship of reunion.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>                           The power to do complete justice is the very essence of<br \/>\n                           every judicial justice dispensation system. It cannot be<br \/>\n                           diluted by distorted perceptions and is not a slave to<br \/>\n                           anything, except to the caution and circumspection, the<br \/>\n                           standards of which the Court sets before it, in exercise of<br \/>\n                           such plenary and unfettered power inherently vested in it<br \/>\n                           while donning the cloak of compassion to achieve the ends<br \/>\n                           of justice.\n<\/p><\/blockquote>\n<blockquote><p>                 29.       No embargo, be in the shape of Section 320(9) of the<br \/>\n                           Cr.P.C., or any other such curtailment, can whittle down the<br \/>\n                           power under Section 482 of the Cr.P.C.\n<\/p><\/blockquote>\n<blockquote><p>                 30.       The compromise, in a modern society, is the sine qua non<br \/>\n                           of harmony and orderly behaviour. It is the soul of justice<br \/>\n                           and if the power under Section 482 of the Cr.P.C is used to<br \/>\n                           enhance such a compromise which, in turn, enhances the<br \/>\n                           social amity and reduces friction, then it truly is &#8220;finest hour<br \/>\n                           of justice&#8221;. Disputes which have their genesis in a<br \/>\n                           matrimonial discord, landlord- tenant matters, commercial<br \/>\n                           transactions and other such matters can safely be dealt<br \/>\n                           with by the Court by exercising its powers under Section<br \/>\n                           482 of the Cr.P.C in the event of a compromise, but this is<br \/>\n                           not to say that the power is limited to such cases. There<br \/>\n                           can never be any such rigid rule to prescribe the exercise of<br \/>\n                           such power, especially in the absence of any premonitions<br \/>\n                           to forecast and predict eventualities which the cause of<br \/>\n                           justice may throw up during the course of a litigation.\n<\/p><\/blockquote>\n<blockquote><p>                 31.       The only inevitable conclusion from the above discussion is<br \/>\n                           that there is no statutory bar under the Cr.P.C which can<br \/>\n                           affect the inherent power of this Court under Section 482.\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> Criminal Misc. No.-M-28859 of 2008 (O&amp;M)                          3<\/span><\/p>\n<blockquote><p>                           Further, the same cannot be limited to matrimonial cases<br \/>\n                           alone and the Court has the wide power to quash the<br \/>\n                           proceedings     even    in   non-compoundable       offences<br \/>\n                           notwithstanding the bar under Section 320 of the Cr.P.C., in<br \/>\n                           order to prevent the abuse of law and to secure the ends of<br \/>\n                           justice.\n<\/p><\/blockquote>\n<blockquote><p>                 32.       The power under Section 482 of the Cr.P.C is to be<br \/>\n                           exercised Ex-Debitia Justitia to prevent an abuse of<br \/>\n                           process of Court. There can neither be an exhaustive list<br \/>\n                           nor the defined para-meters to enable a High Court to<br \/>\n                           invoke or exercise its inherent powers. It will always depend<br \/>\n                           upon the facts and circumstances of each case. The power<br \/>\n                           under Section 482 of the Cr.P.C has no limits. However, the<br \/>\n                           High Court will exercise it sparingly and with utmost care<br \/>\n                           and caution. The exercise of power has to be with<br \/>\n                           circumspection and restraint. The Court is vital and an<br \/>\n                           extra-ordinary effective instrument to maintain and control<br \/>\n                           social order. The Courts play role of paramount importance<br \/>\n                           in achieving peace, harmony and ever-lasting congeniality<br \/>\n                           in society. Resolution of a dispute by way of a compromise<br \/>\n                           between two warring groups, therefore, should attract the<br \/>\n                           immediate and prompt attention of a Court which should<br \/>\n                           endeavour to give full effect to the same unless such<br \/>\n                           compromise is abhorrent to lawful composition of the<br \/>\n                           society or would promote savagery.&#8221;<\/p><\/blockquote>\n<p>                 Compromise in modern society is the sine qua non of harmony and<br \/>\norderly behaviour. As observed by Krishna Iyer J., the finest hour of justice<br \/>\narrives propitiously when parties despite falling apart, bury the hatchet and<br \/>\nweave a sense of fellowship of reunion. Inherent power of the Court under<br \/>\nSection 482 Cr.P.C is not limited to matrimonial cases alone. The Court has wide<br \/>\npowers to quash the proceedings even in non-compoundable offences in order<br \/>\nto prevent abuse of process of law and to secure ends of justice, notwithstanding<br \/>\nbar under Section 320 Cr.P.C. Exercise of power in a given situation will depend<br \/>\non facts of each case. The duty of the Court is not only to decide a lis between<br \/>\nthe parties after a protracted litigation but it is a vital and extra-ordinary<br \/>\ninstrument to maintain and control social order. Resolution of dispute by way of<br \/>\ncompromise between two warring groups should be encouraged unless such<br \/>\ncompromise is abhorrent to lawful composition of society or would promote<br \/>\nsavagery, as held in Kulwinder Singh&#8217;s case (supra).\n<\/p>\n<p>                 Keeping in view the enunciation of law as referred to above and<br \/>\napplying the same to the facts and circumstances of the present case, once the<br \/>\nmatter has been compromised between the parties, no useful purpose will be<br \/>\n<span class=\"hidden_text\"> Criminal Misc. No.-M-28859 of 2008 (O&amp;M)                    4<\/span><\/p>\n<p>served by proceeding with the prosecution.
