Heard       Shri       Hare      Krishna         Kumar,<\/p>\n<p>                  learned counsel for the petitioner and Shri<\/p>\n<p>                  Pramanand    Kumar,       learned        Additional         Public<\/p>\n<p>                  Prosecutor.\n<\/p>\n<p>                             The   petitioner,          who      is    in     custody<\/p>\n<p>                  since     24.10.2010          for     the      offence        under<\/p>\n<p>                  Sections 467, 468, 406 and 420 of the Indian<\/p>\n<p>                  Penal Code in Warisaliganj P.S. Case No.176<\/p>\n<p>                  of 2010, has prayed for grant of bail.<\/p>\n<p>                             Allegation as per F.I.R. is that the<\/p>\n<p>                  petitioner       being        a     mediator,         had     taken<\/p>\n<p>                  Rs.44,500\/-.       Accordingly,             an       F.I.R.      was<\/p>\n<p>                  lodged.\n<\/p>\n<p>                             Learned      counsel       for      the    petitioner<\/p>\n<p>                  submits     that        prior       to      lodging         F.I.R.,<\/p>\n<p>                  illegal search was conducted in the house of<\/p>\n<p>                  the petitioner and Rs.45,000\/- was forcibly<\/p>\n<p>                  recovered and while the petitioner started<\/p>\n<p>                  demanding,       the      present         case       was      filed<\/p>\n<p>                  implicating       the    petitioner            on    24.10.2010.<\/p>\n<p>                  From the impugned order, it appears that the<\/p>\n<p>                  recovery    was    made       from       the     house      of   the<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>        petitioner long before lodging of the F.I.R.<\/p>\n<pre>                   In    view       of     the       facts      and\n\n        circumstances,        let   the     petitioner       above\n\n<\/pre>\n<p>        named be enlarged on bail on his furnishing<\/p>\n<p>        bond of Rs.10,000\/- (ten thousand) with two<\/p>\n<p>        sureties    of   the    like     amount     each   to   the<\/p>\n<p>        satisfaction     of    Chief     Judicial    Magistrate,<\/p>\n<p>        Nawada in Warisaliganj P.S.
