BACK for Respondent :\n2. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 19\/01\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\nthe petitioner has prayed to direct the respondents to make necessary<br \/>\ncorrection in the date of birth of the petitioner as entered in the<br \/>\nSchool Leaving Certificate and to issue a fresh School Leaving<br \/>\nCertificate with the correct date of birth.\n<\/p>\n<p>2.\tThe<br \/>\nfacts in brief are that the petitioner was born on 11.10.1966 at<br \/>\nVillage Sarsa, Taluka and District Anand and her date of birth was<br \/>\nentered as such in the Birth Certificate maintained under the<br \/>\nprovisions of the Registration of Births &amp; Deaths Act, 1969.<br \/>\nHowever, while taking admission in the school, her date of birth was<br \/>\nwrongly entered as 12.10.1966 and accordingly, in the School Leaving<br \/>\nCertificate, her date of birth has been entered as 12.10.1966 instead<br \/>\nof 11.10.1966. When the petitioner applied for Visa, the said fact<br \/>\ncame to her notice and therefore, she approached the<br \/>\nrespondent-authority by way of a representation with a request to<br \/>\nrectify the said error. However, the respondent-authority declined to<br \/>\ncarry out the correction. Hence, this petition.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. Regulation 12-A of the Gujarat Secondary Education<br \/>\nRegulations provide that the school record cannot be corrected<br \/>\nafter the pupil leaves the school and that in such case, the only<br \/>\nremedy available is to approach the learned Magistrate, First Class,<br \/>\nhaving jurisdiction in the matter, for redressal of the grievance, as<br \/>\nprovided under Section 13(3) of the Registration of Births &amp;<br \/>\nDeaths Act.\n<\/p>\n<p>4.\tSuch<br \/>\nprinciple has also been laid down in a recent decision of this Court<br \/>\nrendered in the case of Regional Passport Officer v. Kokilaben,<br \/>\nw\/o. Jaswantlal Panchal &amp; Ors., 2009(2) G.L.H. 1246.\n<\/p>\n<p>5.\tTherefore,<br \/>\nin the present case also, the appropriate remedy available to the<br \/>\npetitioner is to approach the concerned Magistrate, First Class or<br \/>\nthe Civil Court, as the case may be, by way of appropriate<br \/>\napplication. It is observed that if the petitioner approaches the<br \/>\nconcerned Magistrate, First Class or the Civil Court, as the case may<br \/>\nbe, having jurisdiction in the matter, by way of appropriate<br \/>\napplication, within a period of four weeks from today, the concerned<br \/>\nlearned Magistrate, First Class or the Civil Court, shall decide the<br \/>\nsaid application of the petitioner, in accordance with law, within a<br \/>\nperiod of eight weeks from the date of receipt of such application<br \/>\nfrom the petitioner. With the above observations, the petition stands<br \/>\ndisposed of.
