SHAH\n\t\t\n\t\n\n \n\nDate\n: 25\/01\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\tPresent<br \/>\napplication has been preferred by the applicant &#8211; original<br \/>\nappellant &#8211; National Insurance Company Limited for interim<br \/>\nrelief to stay further execution, implementation and operation of the<br \/>\njudgment and award dated 18.08.2010 passed by the learned Motor<br \/>\nAccident Claims Tribunal (Auxi.), FTC No.2, Himatnagar, Camp at Idar<br \/>\nin M.A.C.P. No.123\/2007, till the final disposal of the main First<br \/>\nAppeal.\n<\/p>\n<p>2.\tShri<br \/>\nMaulik Shelat, learned advocate appearing on behalf of the applicant<br \/>\nhas stated at the Bar that pursuant to the order passed by this Court<br \/>\ndated 16\/12\/2010, applicant has already deposited the entire amount<br \/>\nas awarded by the learned Tribunal.\n<\/p>\n<p>3.\tThough<br \/>\nserved, nobody appears on behalf of respondent &#8211; original<br \/>\nclaimant.  While issuing Rule, the learned Single Judge has granted<br \/>\nad-interim relief and passed the following order..\n<\/p>\n<p>Rule<br \/>\nreturnable on 25.01.2011.  By way of ad-interim relief, In the<br \/>\nmeanwhile there shall be ad-interim relief in terms of paragraph 3(A)<br \/>\non the condition that the applicant shall deposit the decretal amount<br \/>\nbefore the Tribunal.\n<\/p>\n<p>\tOn<br \/>\ndepositing the entire decretal amount by the applicant-<br \/>\nInsurance Company together with accrued interest and costs, Claims<br \/>\nTribunal concerned is directed to invest 50% thereof in any<br \/>\nNationalized Bank in the name of respondent claimant\/s initially for<br \/>\na period of three years with periodical renewal with a condition that<br \/>\nclaimants will get quarterly interest upon said FDR till the appeal<br \/>\nis finally decided by this Court.   The interest amount be paid to<br \/>\nwife Kiranben, mother-Khumaben and father-Bhikhabhai in the ratio of<br \/>\n2:1:1 .\n<\/p>\n<p>\tThough<br \/>\nthe said FDR is in the name of respondent-claimant\/s, it shall remain<br \/>\nwith Nazir of Claims Tribunal concerned till the appeal is finally<br \/>\ndecided by this Court.\n<\/p>\n<p>\tThe<br \/>\nrest of 50% amount is permitted to be withdrawn by the<br \/>\nrespondent-claimant\/s, by account payee cheque, after proper<br \/>\nverification subject to final result in the appeal in the following<br \/>\nshare:-\n<\/p>\n<p>\tKiranben<br \/>\nWd\/o Prakashbhai Patel\t\t&#8211;\t25%<\/p>\n<p>\tKhumaben<br \/>\nBhikhabhai Patel\t\t\t&#8211;\t12.5%<\/p>\n<p>\tBhikhabhai<br \/>\nGababhai Patel\t\t\t&#8211;\t12.5%<\/p>\n<p>\tRespondents<br \/>\nare permitted to be served by Direct Service as well as Registered<br \/>\nPost AD.\n<\/p>\n<p>4.\tHence,<br \/>\nad-interim relief granted earlier is directed to be continued as<br \/>\ninterim relief till the final disposal of the appeal on the same<br \/>\nterms and conditions.  Rule is made absolute accordingly.
