SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/09\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>By<br \/>\n\tway of this petition under Article 227 of the Constitution of India,<br \/>\n\tthe petitioner  has  prayed for appropriate writ, order and\/or<br \/>\n\tdirection, quashing and setting aside the impugned judgement and<br \/>\n\taward dtd.6\/4\/1995<br \/>\n\tpassed by the Labour Court,  Bhavnagar in Reference<br \/>\n\t(LCB) No.159 of 1993, by which the Labour Court has dismissed the<br \/>\n\tsaid reference.\n<\/p>\n<p>The<br \/>\n\tpetitioner<br \/>\n\t was appointed as a reliever Watchman and as and when<br \/>\n\tthe work was available  on non-availability of regular Watchman, he<br \/>\n\twas called for duty and during the period between October, 1982 and<br \/>\n\tMarch, 1984, in all the petitioner<br \/>\n\t workman worked only for 228 days.  It appears that as<br \/>\n\tthe work  was not available, he was not for duty on and from<br \/>\n\t31\/3\/1984 and therefore, the petitioner<br \/>\n\t raised an industrial dispute, which came to be<br \/>\n\tdismissed by the Labour Court by holding that the appointment of the<br \/>\n\tpetitioner<br \/>\n\t was on contractual basis as reliever Watchman and<br \/>\n\tthat he has not worked for 240 days in the last preceding year.<br \/>\n\tBeing aggrieved by and dissatisfied with the impugned judgement and<br \/>\n\taward passed by the Labour Court in dismissing the aforesaid<br \/>\n\treference, the petitioner<br \/>\n\t has preferred the present Special<br \/>\n\tCivil Application  under Article 227 of the<br \/>\n\tConstitution of India.\n<\/p>\n<p>Having<br \/>\n\theard the learned<br \/>\n\tadvocate appearing on behalf of the respective parties<br \/>\n\tand considering the aforesaid facts and circumstances, more<br \/>\n\tparticularly when the appointment of the petitioner<br \/>\n\t workman was found to be on contractual basis as<br \/>\n\treliever Watchman and considering the fact that as and when the work<br \/>\n\twas available and on non-availability of regular Watchman, the<br \/>\n\tpetitioner<br \/>\n\t was called for duty and considering the fact that the<br \/>\n\tpetitioner<br \/>\n\t workman has worked only for 228 days during the<br \/>\n\tperiod between October, 1982 and March, 1984, and that the the<br \/>\n\tpetitioner<br \/>\n\t workman has not worked for 240 days, it cannot be<br \/>\n\tsaid that the Labour Court has committed any error and\/or illegality<br \/>\n\tin dismissing the reference, which calls for interference of this<br \/>\n\tCourt in exercise of powers under Article 227 of the Constitution<br \/>\n\tof India. The impugned judgement and award passed by<br \/>\n\tthe Labour Court is just and legal and no interference at the hands<br \/>\n\tof this Court is called for.\n<\/p>\n<p>In<br \/>\n\tview of the above and for the reasons stated above,    there is no<br \/>\n\tsubstance in the present petition, which deserves to be dismissed<br \/>\n\tand is accordingly dismissed. Rule is discharged.
