JOSEPH, J.\n\n            ````````````````````````````````````````````````````\n                  W.P.(C) No. 29070 OF 2008 I\n            ````````````````````````````````````````````````````\n          Dated this the 30th day of September, 2008\n\n                          J U D G M E N T\n<\/pre>\n<p>           Writ petition has been taken up for final hearing by<\/p>\n<p>the consent of the parties.            I heard learned counsel for<\/p>\n<p>petitioner and learned Government Pleader.<\/p>\n<p>      2.   Petitioner has pressed before me two complaints.<\/p>\n<p>Firstly, he points out that aggrieved by the order passed<\/p>\n<p>imposing penalty under section 67(1) of the KVAT Act,<\/p>\n<p>petitioner preferred appeal and also filed application seeking<\/p>\n<p>stay.   Ext.P6 order came to be passed granting stay on<\/p>\n<p>condition that the petitioner pays 50% of the penalty and<\/p>\n<p>furnishes adequate security for the              balance amount.   He<\/p>\n<p>further points out that Ext.P6 is passed mechanically against<\/p>\n<p>the dictum of the Division Bench of this Court reported in<\/p>\n<p>Supreme Electrical Enginerring (P) Ltd. Vs. Commercial<\/p>\n<p>Tax Officer [2008 (3) KLT 805]. I feel that Ext.P6 cannot be<\/p>\n<p>sustained and accordingly, Ext.P6 is quashed and the 2nd<\/p>\n<p>WPC.29070\/08<br \/>\n<span class=\"hidden_text\">                               : 2 :<\/span><\/p>\n<p>respondent will take up the application for stay and pass fresh<\/p>\n<p>orders in accordance with law, within three weeks from the<\/p>\n<p>date of receipt of a copy of this judgment. Till such orders are<\/p>\n<p>passed, recovery steps will be kept in abeyance. Petitioner<\/p>\n<p>will produce a copy of this judgment before the 2nd respondent<\/p>\n<p>as soon as it is received.\n<\/p>\n<p>      3.   The further complaint of the petitioner is that<\/p>\n<p>though the petitioner has preferred Ext.P4 petition seeking to<\/p>\n<p>get the delay condoned in filing the application for<\/p>\n<p>compounding before the 4th respondent, the 4th respondent<\/p>\n<p>has not passed any order thereon so far. Without expressing<\/p>\n<p>any view on the merits or the maintainability of the petition,<\/p>\n<p>there will be a further direction to the 4th respondent to<\/p>\n<p>consider and take a decision on Ext.P4 in accordance with<\/p>\n<p>law, within two months from the date of receipt of a copy of<\/p>\n<p>this judgment.\n<\/p>\n<p>      Writ petition is disposed of as above.\n<\/p>\n<p>                                                           Sd\/-\n<\/p>\n<p>                                         (K.M.JOSEPH, JUDGE)<br \/>\naks<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sri.
