OF GUJARAT &amp; 3 - Respondent(s)\n \n\n=========================================================\n \nAppearance\n: \nMR\nBP GUPTA for\nPetitioner(s) : 1 - 7. \nRULE NOT RECD BACK for Respondent(s) : 1,3\n- 4. \nMS SACHI MATHUR, Assistant Government Pleader for\nRespondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.A.PUJ\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/07\/2010  \n \nORAL ORDER<\/pre>\n<p>\tThe Civil Application<br \/>\n\tNo.267 of 2010 is filed for condonation of delay of 1256 days caused<br \/>\n\tin filing an application for bringing legal heirs of Kishanchand<br \/>\n\tHiromal on record of Second Appeal No.195 of 1983.\n<\/p>\n<p>\tThe Civil Application<br \/>\n\t(Stamp) No.4708 of 2009 is filed for bringing the legal heirs of<br \/>\n\tappellant No.1 on record of Second Appeal No.195 of 1983.\n<\/p>\n<p>\tHeard Mr.B.P.Gupta,<br \/>\n\tlearned advocate appearing for the applicants in both these Civil<br \/>\n\tApplications and Ms.Sachi Mathur, learned Assistant Government<br \/>\n\tPleader appearing for the respondent State.\n<\/p>\n<p>\tThe appellant No.1 i.e.<br \/>\n\tKishanchand Hiromal has expired on 26.11.2005. His Death Certificate<br \/>\n\tis on record. The application for bringing the legal heirs on record<br \/>\n\twas filed on 29.4.2009.  Mr.Gupta has submitted that the legal heirs<br \/>\n\tof the appellant No.1 are not educated persons and and they do not<br \/>\n\tknow the intricacies of legal procedure and, therefore, they could<br \/>\n\tnot approach this Court immediately. Accordingly delay was caused in<br \/>\n\tfiling an application for bringing legal heirs on record. He has<br \/>\n\tfurther submitted that there is no intentional delay on the part of<br \/>\n\tthe applicant and as soon as the applicants were advised by their<br \/>\n\tadvocate the present application is filed. He has, therefore,<br \/>\n\tsubmitted that the delay may be condoned and legal heirs be<br \/>\n\tpermitted to be brought on record.\n<\/p>\n<p>\tMs.Sachi Mathur, learned<br \/>\n\tAssistant Government Pleader appearing for the respondent State, on<br \/>\n\tthe other hand, has objected this application and submitted that<br \/>\n\tthere is gross delay of 1256 days and there is no satisfactory<br \/>\n\texplanation given as to why such delay is caused. She has,<br \/>\n\ttherefore, submitted that the application may be rejected.\n<\/p>\n<p>\tHaving heard the learned<br \/>\n\tadvocate Mr.Gupta appearing for the applicants and Ms.Mathur,<br \/>\n\tlearned Assistant Government Pleader and having gone through the<br \/>\n\taverments made in the application the Court is satisfied that there<br \/>\n\tis reasonable cause in not filing application in time. Even<br \/>\n\totherwise, the suit was filed by Hiromal Mohandas.  The First Appeal<br \/>\n\twas also filed by Hiromal Mohandas. However, before this Court<br \/>\n\tSecond Appeal was filed by Kishanchand Hiromal and Mansharam<br \/>\n\tHiromal.  During the pendency of this Second Appeal Kishanchand<br \/>\n\texpired and hence legal heirs of Kishanchand are required to be<br \/>\n\tbrought on record. If the delay is condoned it would not cause<br \/>\n\tprejudice to any one.\n<\/p>\n<p>\tIn the above view of the<br \/>\n\tmatter, delay in filing the application for bringing legal heirs on<br \/>\n\trecord is hereby condoned. Similarly the legal heirs of late<br \/>\n\tKishanchand are directed to be brought on record.\n<\/p>\n<p>\tIn the result both these<br \/>\n\tapplications are accordingly allowed. Rule is made absolute without<br \/>\n\tany order as to costs.\n<\/p>\n<p>\tOffice is directed to<br \/>\n\tgive pukka number to Civil Application (Stamp) No.4708 of 2009 and,<br \/>\n\tthereafter, it is shown to be disposed off. Office is further<br \/>\n\tdirected to place Second Appeal No.195 1983 for final hearing on<br \/>\n\t6.8.2010.\n<\/p>\n<p>    (K. A. PUJ.
