No.22059\/2008-A\n              ~~~~~~~~~~~~~~~~~~~~~~~~~~~\n         Dated this the 6th day of December, 2010\n\n                    J U D G M E N T\n<\/pre>\n<p>    The petitioner herein was an applicant to the post<\/p>\n<p>of Vocational Teachers in Medical Laboratory Technician<\/p>\n<p>in the Department of Vocational Higher Secondary School<\/p>\n<p>Education.  The qualification of the petitioner is Post<\/p>\n<p>Graduation in Medical Laboratory Technology wherein he<\/p>\n<p>had  secured   61.17%   for  M.Sc.(Medical   Laboratory<\/p>\n<p>Technology) and 54.98% for Degree of Bachelor Science<\/p>\n<p>in M.L.T.  The petitioner is a Scheduled Caste.<\/p>\n<p>    2.   The notification herein is dated 05\/10\/2004.<\/p>\n<p>Going  by  the   notification,  at  Degree   level  the<\/p>\n<p>candidate should have obtained 60% marks.  According to<\/p>\n<p>the petitioner, he is having 61.17% marks in M.Sc.(MLT)<\/p>\n<p>and, accordingly, he applied  for the post.   He passed<\/p>\n<p>in the written examination and was included in the<\/p>\n<p>ranked list also.   Subsequent to the verification of<\/p>\n<p>his certificates, his application was rejected as he<\/p>\n<p>was not having 60% marks in B.Sc (MLT).  The petitioner<\/p>\n<p>claims inclusion in the interview on the basis of P.G<\/p>\n<p>qualification.  But, as on the last date for receipt of<\/p>\n<p>W.P.(C). No.22059\/2008<br \/>\n<span class=\"hidden_text\">                         -:2:-<\/span><\/p>\n<p>the application, i.e. 24\/11\/2004, the petitioner has<\/p>\n<p>not acquired P.G qualification.  Ext.P2 P.G certificate<\/p>\n<p>is dated 07\/07\/2006.   Admittedly, the acquisition of<\/p>\n<p>the  P.G  qualification is   on  a  later  date.   The<\/p>\n<p>amendment of the qualification with regard to the marks<\/p>\n<p>of Degree examination brought out by Ext.P6 is also on<\/p>\n<p>a later date, namely, 23\/06\/2007.  Therefore, that also<\/p>\n<p>will not help the petitioner.     In that view of the<\/p>\n<p>matter,  the  writ  petition  fails and   the  same  is<\/p>\n<p>dismissed.
