For ready<br \/>\nperusal, relevant Clauses of Section-19 are reproduced:-\n<\/p>\n<p> 19.\tThe<br \/>\nSmall Cause Court shall have no jurisdiction in-\n<\/p>\n<p>(a) to (f)\txxxx<\/p>\n<p>(g)\tsuits for<br \/>\nthe determination of any other right to or interest in immovable<br \/>\nproperty;\n<\/p>\n<p>(h)\tsuits for<br \/>\nthe specific performance or rescission of contracts;\n<\/p>\n<p>(i) to<br \/>\n(w)\txxxx <\/p>\n<p>4.\t\tLearned<br \/>\nAdvocate Ms.P.C.Fernandez for learned Advocate Mr.R.D.Raval for the<br \/>\nrespondent submitted that the present petitioner had filed<br \/>\napplication Exh.53 in the same proceedings.  A copy of application<br \/>\nExh.53 is produced along with affidavit of Shri Arunbhai Popatlal<br \/>\nThakkar at page No.98, whereby the present petitioner had prayed that<br \/>\npreliminary issue be framed under O-14 R-2 of the Code of Civil<br \/>\nProcedure.  The issues which are required to be framed by original<br \/>\ndefendant No.2 are contained in para-3 of that application, which<br \/>\nreads as under:-\n<\/p>\n<p> 3)\tThat, the<br \/>\ndefendant further submits that, he has raised the contentions about<br \/>\nthe limitation also as the plaintiff have filed the suit for the<br \/>\nSpecific Performance of the Agreement dated: 31\/12\/2003 which is<br \/>\nclearly barred by Law of Limitation as the suit is filed in the year<br \/>\n2008 i.e. after 5 Years and as such, the suit is not maintainable and<br \/>\ntherefore the following issues are required to be framed as a Legal<br \/>\nissues:-\n<\/p>\n<p>\t Whether<br \/>\n\tthe suit is barred by Jurisdiction?\n<\/p>\n<p>\t Whether<br \/>\n\tthe suit is barred by Limitation?\n<\/p>\n<p>\tWhether the<br \/>\n\tsuit is maintainable as framed?\n<\/p>\n<p>\t              (emphasis<br \/>\n\tsupplied)\t <\/p>\n<p>4.1\t\tThis<br \/>\napplication came to be decided by the Court below by order dated<br \/>\n10.03.2010.  Incidentally, it is decided by the same learned Judge.<br \/>\nThe relevant paras-5 and 6 of the order reads as under:-\n<\/p>\n<p> 5.\t&#8230;&#8230;&#8230;&#8230;&#8230;\n<\/p>\n<p>earlier also she has submitted one application exh.34 on the same<br \/>\ngrounds as set out in the present application and the Hon&#8217;ble Court<br \/>\nhas disposed the same on 30.9.2009, but after that she was not ready<br \/>\nto argue out for the application exh.6.   Even on 9.3.2010, she<br \/>\ngave assurance to this Court for hearing of application exh.6 but<br \/>\ninstead of doing so, she has filed this application exh.52 for<br \/>\nframing the preliminary issues.  So, looking to the documents<br \/>\nproduced on record, it is clearly established that the present<br \/>\nplaintiff and others are originally tenants of Trust property and<br \/>\ntrust has already obtained permission to sell the property and the<br \/>\ndefendant no.3 has purchased the same by registered sale-deed<br \/>\ndtd.7.1.2006 with condition of possession and the plaintiff has filed<br \/>\nthis suit on the same ground of tenant.  So, as per my view, this<br \/>\nCourt has jurisdiction to try the suit.  Moreover, other tenants of<br \/>\nthe suit property have filed H.R.P. Suit No.1342 of 2008 and<br \/>\n1343\/2008 before the Small Cause Court and when the Small Cause Court<br \/>\nhas already decided the interim injunction application then it<br \/>\nappears from the record that the plaintiff is original tenant of<br \/>\ntrust property and on that point, they have filed the suit before<br \/>\nSmall Cause Court.\n<\/p>\n<p>6.\t&#8230;&#8230;&#8230;&#8230;&#8230;\n<\/p>\n<p> Now looking to the entire documents on record, it is not proper to<br \/>\nframe the preliminary issues on above points, but if such issues are<br \/>\nframed at later stage then the defendant shall cause no prejudice.<br \/>\nFurthermore, the interim injunction application is pending since<br \/>\nlong.  As per the directions of the Hon&#8217;ble Gujarat High Court, the<br \/>\nCourt is duty bound to dispose of the ad interim injunction<br \/>\napplication as early as possible, even though the Court has granted<br \/>\nample time for hearing and there is no any interim order of stay for<br \/>\napplication exh.6.  Hence, as per my view, this application is not<br \/>\ntenable at law at this stage.  Moreover, Ms.Shah for the defendant<br \/>\nhas cited one one judgment reported in 2000 (9) G.L.H. 1 Uttar<br \/>\nGujarat Vij Co. Ltd. and Anr. Vs. Dhulabhai Kodarbhai Vankar and Anr.<br \/>\n But looking to the ratio laid down by Hon&#8217;ble The Apex Court in the<br \/>\nsaid judgment, I do agree with the said ratio, but it is not<br \/>\napplicable in the present case because here it clearly appears that<br \/>\nthe plaintiff is originally tenant of the disputed property and the<br \/>\ndefendant has purchased the same on 7.1.2006.  Moreover, it is a<br \/>\nmixed question of law and facts involved in this matter and hence,<br \/>\nthe cited judgment is not helpful to the case of the L.A. for the<br \/>\ndefendant.  L.A. Ms.Shah has argued that one agreement between both<br \/>\nthe parties is executed on 31.12.2003, but looking to the copy of the<br \/>\nsaid agreement produced on record at mark-4\/1, it is only an<br \/>\nagreement of contract and thereafter, the defendant no.3 has<br \/>\npurchased the disputed property by registered sale-deed on 7.01.2006<br \/>\nhere produced at mar-38\/2.\n<\/p>\n<p>(emphasis<br \/>\nsupplied)  <\/p>\n<p>5.\t\tThe<br \/>\nsubmission of learned Advocate Ms.Fernandez for the respondent is<br \/>\nfound to be without any merits inasmuch as, if the petitioner was<br \/>\nchallenging an order passed below application Exh.53 which<br \/>\nis of subsequent date, i.e. 10.03.2010 then it could have been argued<br \/>\nthat the petitioner is trying to bring the order passed below<br \/>\napplication Exh.34 dated 30.09.2009 within the limitation period.<br \/>\nHere it is otherwise.  The order challenged is passed below<br \/>\napplication Exh.34 and that is the first order, whereby the Court did<br \/>\nnot accept the contention of the petitioner herein   original<br \/>\ndefendant that the Court has no jurisdiction.  Besides, learned<br \/>\nSenior Advocate for the petitioner invited attention of the Court to<br \/>\nthe conduct of the present respondent from a document, a copy of<br \/>\nwhich is produced at Annexure-C to this petition,<br \/>\nwherein he has accepted a handsome amount of Rs.21 lacs by cheque and<br \/>\nnot only that, the petitioner has produced documentary evidence not<br \/>\nonly to show that, that amount is debited from his account but also<br \/>\nto show that, that amount was credited in the account of the tenant.<br \/>\nAfter having pocketed an amount of Rs.21 lacs, to challenge the<br \/>\ntransaction in the Small Causes Court is nothing but an attitude<br \/>\nwhich is required to be deprecated.\n<\/p>\n<p>Be that as it<br \/>\nmay, for the present, the Court is required to consider    as to<br \/>\nwhether the Small Causes Court has jurisdiction to decide about<br \/>\nvalidity of a particular document.  In the opinion of this Court,<br \/>\neven if the validity of a document is required to be challenged, it<br \/>\nis required to be challenged before the appropriate Court and after<br \/>\nhaving obtained a declaration that the document is null and void, the<br \/>\ndefendant tenant is required to go to the Court of Small Causes.\n<\/p>\n<p>6.\tIn view of<br \/>\nthe above, the matter requires.\n<\/p>\n<p>\t RULE.\n<\/p>\n<p>\tInterim<br \/>\nrelief in terms of<br \/>\npara-22-[C].\n<\/p>\n<p>\tAdmission of<br \/>\nthis petition should not preclude the parties from arriving at an<br \/>\namicable settlement of the dispute.\n<\/p>\n<p>(Ravi<br \/>\nR.Tripathi, J.)<\/p>\n<p>*Shitole<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Arnubhai vs Jhamaklal on 15 June, 2010 Author: Ravi R.Tripathi,&amp;Nbsp;
