The revision is against the petition filed by the<\/p>\n<p>defendant in the suit for staying the proceedings and for reference to<\/p>\n<p>arbitration. The fact that the agreement between the parties contained an<\/p>\n<p>arbitral clause, is not denied. The petition was that the suit related to the<\/p>\n<p>recovery of amount for extra work required to be done and therefore the<\/p>\n<p>arbitral clause could not be invoked. This objection was sustained by the<\/p>\n<p>trial Court and the defendant is in revision against this order.<\/p>\n<p>             2.     I have read clause 25 which contains an arbitral clause<\/p>\n<p>which reads as follows:-\n<\/p>\n<blockquote><p>             &#8221; i)   If any dispute or difference of any kind whatsoever<br \/>\n                    shall arise between the PWSSB its authorized<br \/>\n<span class=\"hidden_text\"> Civil Revision No.4210 of 2005                                               -2-<\/span><\/p>\n<p>                    representative and the contractor in connection with<br \/>\n                    or arising out of this contract or the execution of<br \/>\n                    work thereunder.\n<\/p><\/blockquote>\n<blockquote><p>           ii)      &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..\n<\/p><\/blockquote>\n<blockquote><p>           iii)     &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..\n<\/p><\/blockquote>\n<blockquote><p>           iv)      If the Engineer-in-charge fails to convey his decision<br \/>\n                    within a period of sixty days after being requested as<br \/>\n                    aforesaid the contractor may within further sixty days<br \/>\n                    of the expiry of the first sixty days from the date on<br \/>\n                    which the said request was made by the contractor<br \/>\n                    refer the dispute for arbitration as hereinafter<br \/>\n                    provided.\n<\/p><\/blockquote>\n<blockquote><p>           v)       All disputes or differences in respect of which the<br \/>\n                    decision is not final and conclusive shall at the<br \/>\n                    request of either party made in a communication sent<br \/>\n                    through registered A.D. post be referred to the sole<br \/>\n                    arbitration of the Superintending Engineer of the<br \/>\n                    circle concerned in the PWSSB acting as such at the<br \/>\n                    time of reference unless debarred from acting as an<br \/>\n                    Arbitrator by an order of the MD, PWSSB\/Court, in<br \/>\n                    which event, the MD shall appoint any other technical<br \/>\n                    officer not below the rank of Superintending Engineer<br \/>\n                    to act as an arbitrator on receipt of a request from<br \/>\n                    either party.\n<\/p><\/blockquote>\n<blockquote><p>           vi)      &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..\n<\/p><\/blockquote>\n<blockquote><p>           vii)     &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..\n<\/p><\/blockquote>\n<blockquote><p>           viii) &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;..\n<\/p><\/blockquote>\n<blockquote><p>           ix)      The provisions of the Indian Arbitration Act 1940 or<br \/>\n                    any       other       statutory          enactment   thereunder   or<br \/>\n                    modification thereof and for the time being in force<br \/>\n                    shall apply to the arbitration proceedings under this<br \/>\n                    clause.&#8221;<\/p><\/blockquote>\n<p>\n<span class=\"hidden_text\"> Civil Revision No.4210 of 2005                                  -3-<\/span><\/p>\n<p>             3.    In view of the specific provisions relating to<\/p>\n<p>resolution of dispute through arbitration, it shall be impermissible for the<\/p>\n<p>trial Court to allow the proceedings to continue. The petition filed by the<\/p>\n<p>defendant before the Court ought to have therefore allowed staying the<\/p>\n<p>proceedings and referring the matter to the Arbitrator who shall be duly<\/p>\n<p>appointed as per the terms of the agreement. The order of the Court<\/p>\n<p>below is under the circumstances set aside and the proceedings are<\/p>\n<p>directed to be stayed. Having regard to the fact that the dispute has been<\/p>\n<p>brought at the instance of the plaintiff, the defendant shall apply the<\/p>\n<p>arbitration clause and appoint an Arbitrator in the manner provided under<\/p>\n<p>the agreement and proceed with resolution of the dispute before the<\/p>\n<p>Arbitrator in the manner provided.\n<\/p>\n<p>             4.
