\u00a0 Civil \u00a0 Surgeon, \u00a0 Deoghar, \u00a0 to\u00a0<br \/>\n             accept \u00a0 the \u00a0 joining \u00a0 of \u00a0 the \u00a0 petitioner \u00a0 at \u00a0 Primary \u00a0 Health \u00a0 Centre,\u00a0<br \/>\n             Sarwan,\u00a0District\u00a0Deoghar,\u00a0where\u00a0the\u00a0petitioner\u00a0was\u00a0to\u00a0join\u00a0after\u00a0<br \/>\n             his \u00a0 transfer \u00a0 issued \u00a0 by \u00a0 the \u00a0 Regional \u00a0 Deputy \u00a0 Director \u00a0 of \u00a0 Health\u00a0<br \/>\n             Services,\u00a0Santhal\u00a0Pargana\u00a0Division,\u00a0Dumka\u00a0vide\u00a0his\u00a0order\u00a0dated\u00a0<br \/>\n             22nd\u00a0May,\u00a02010\u00a0and\u00a0also\u00a0to\u00a0pay\u00a0the\u00a0entire\u00a0arrears\u00a0of\u00a0salary\u00a0as\u00a0well\u00a0<br \/>\n             as\u00a0current\u00a0salary\u00a0after\u00a0joining\u00a0his\u00a0post\u00a0at\u00a0Primary\u00a0Health\u00a0Centre,\u00a0<br \/>\n             Sarwan,\u00a0District\u00a0Deoghar.\u00a0\n<\/p>\n<p>                    When \u00a0 this \u00a0 case \u00a0 is \u00a0 taken \u00a0 up, \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 the\u00a0<br \/>\n             petitioner\u00a0submitted\u00a0that\u00a0the\u00a0petitioner\u00a0has\u00a0now\u00a0been\u00a0allowed\u00a0<br \/>\n             by\u00a0the\u00a0Civil\u00a0Surgeon\u00a0to\u00a0join\u00a0the\u00a0post\u00a0and,\u00a0accordingly,\u00a0he\u00a0had\u00a0<br \/>\n             given\u00a0his\u00a0joining\u00a0on\u00a0the\u00a0post\u00a0at\u00a0Primary\u00a0Health\u00a0Centre,\u00a0Sarwan,\u00a0<br \/>\n             which\u00a0has\u00a0been\u00a0accepted\u00a0by\u00a0letter\u00a0dated\u00a024th\u00a0 December,\u00a02010\u00a0<br \/>\n             issued\u00a0by\u00a0the\u00a0Civil\u00a0Surgeon,\u00a0Deoghar.\u00a0Regarding\u00a0the\u00a0arrears\u00a0of\u00a0<br \/>\n             salary,\u00a0the\u00a0Civil\u00a0Surgeon\u00a0has\u00a0mentioned\u00a0in\u00a0the\u00a0said\u00a0letter\u00a0that\u00a0the\u00a0<br \/>\n             same \u00a0 shall \u00a0 be \u00a0 considered \u00a0 by \u00a0 the \u00a0 Regional \u00a0 Deputy \u00a0 Director \u00a0 of\u00a0<br \/>\n             Health \u00a0 Services, \u00a0 Santhal \u00a0 Pargana \u00a0 Division, \u00a0 Dumka. \u00a0 Learned\u00a0<br \/>\n             counsel\u00a0submitted\u00a0that\u00a0since\u00a0the\u00a0petitioner\u00a0has\u00a0been\u00a0allowed\u00a0to\u00a0<br \/>\n             join\u00a0the\u00a0post,\u00a0the\u00a0only\u00a0remaining\u00a0grievance\u00a0of\u00a0the\u00a0petitioner\u00a0is\u00a0of\u00a0<br \/>\n             non\u00adpayment\u00a0of\u00a0his\u00a0arrears\u00a0of\u00a0salary\u00a0as\u00a0well\u00a0as\u00a0current\u00a0salary.\u00a0The\u00a0<br \/>\n             petitioner\u00a0approached\u00a0the\u00a0concerned\u00a0authorities\u00a0several\u00a0times,\u00a0<br \/>\n             but\u00a0no\u00a0order\u00a0has\u00a0been\u00a0passed\u00a0till\u00a0date.\u00a0It\u00a0has\u00a0been\u00a0submitted\u00a0<br \/>\n             that\u00a0for\u00a0non\u00adpayment\u00a0of\u00a0salary,\u00a0the\u00a0petitioner\u00a0has\u00a0been\u00a0put\u00a0to\u00a0<br \/>\n             untold\u00a0hardship\u00a0and\u00a0has\u00a0been\u00a0reduced\u00a0to\u00a0penny.\u00a0\u00a0\n<\/p>\n<p>                    Learned\u00a0J.C.\u00a0to\u00a0G.P.II,\u00a0appearing\u00a0on\u00a0behalf\u00a0of\u00a0the\u00a0State,\u00a0<br \/>\n             submitted\u00a0that\u00a0the\u00a0Regional\u00a0Deputy\u00a0Director\u00a0of\u00a0Health\u00a0Services,\u00a0<br \/>\n             Santhal\u00a0Pargana\u00a0Division,\u00a0Dumka\u00a0is\u00a0the\u00a0competent\u00a0authority\u00a0to\u00a0<br \/>\n             consider\u00a0the\u00a0petitioner&#8217;s\u00a0grievance\u00a0and\u00a0pass\u00a0appropriate\u00a0order\u00a0in<br \/>\n                                            \u00ad2\u00ad<br \/>\n\u00a0             accordance\u00a0with\u00a0law.\u00a0\n<\/p>\n<p>                     Considering\u00a0the\u00a0said\u00a0submissions\u00a0made\u00a0by\u00a0learned\u00a0counsel\u00a0<br \/>\n              for\u00a0the\u00a0parties,\u00a0this\u00a0writ\u00a0petition\u00a0is\u00a0disposed\u00a0of,\u00a0giving\u00a0liberty\u00a0to\u00a0the\u00a0<br \/>\n              petitioner\u00a0to\u00a0file\u00a0a\u00a0fresh\u00a0representation,\u00a0along\u00a0with\u00a0a\u00a0copy\u00a0of\u00a0this\u00a0<br \/>\n              order,\u00a0 before \u00a0 the \u00a0 Regional \u00a0 Deputy \u00a0 Director \u00a0 of \u00a0 Health \u00a0 Services,\u00a0<br \/>\n              Santhal\u00a0Pargana\u00a0Division,\u00a0Dumka\u00adRespondent\u00a0no.3\u00a0regarding\u00a0his\u00a0<br \/>\n              grievance. \u00a0 On \u00a0 receipt \u00a0 of \u00a0 such \u00a0 representation, \u00a0 the \u00a0 said\u00a0<br \/>\n              respondent\u00a0shall\u00a0consider\u00a0the\u00a0same\u00a0and\u00a0pass\u00a0appropriate\u00a0order\u00a0<br \/>\n              in\u00a0accordance\u00a0with\u00a0law\u00a0within\u00a0a\u00a0period\u00a0of\u00a0four\u00a0weeks\u00a0from\u00a0the\u00a0<br \/>\n              date\u00a0of\u00a0receipt\u00a0of\u00a0the\u00a0representation.\u00a0If\u00a0the\u00a0petitioner&#8217;s\u00a0claim\u00a0is\u00a0<br \/>\n              found\u00a0admissible,\u00a0the\u00a0admitted\u00a0amount\u00a0of\u00a0arrears\u00a0shall\u00a0be\u00a0paid\u00a0<br \/>\n              to\u00a0the\u00a0petitioner\u00a0within\u00a0a\u00a0period\u00a0of\u00a0six\u00a0weeks\u00a0thereafter.\u00a0The\u00a0said\u00a0<br \/>\n
