RAMKUMAR, J.\n            ---------------------------------------------------\n                Bail Application No.396 of 2011\n            ----------------------------------------------------\n            Dated this the 24th day of January, 2011\n\n                                 ORDER\n<\/pre>\n<p>      Petitioner, who is accused No.1 in Crime No.1438 of 2010<\/p>\n<p>of Anchalumoodu Police Station for offences punishable under<\/p>\n<p>Sections 143, 147, 148, 323, 324 &amp; 308 read with Section 149<\/p>\n<p>I.P.C., seeks anticipatory bail.\n<\/p>\n<p>      2.    The    learned      Public     Prosecutor       opposed  the<\/p>\n<p>application.\n<\/p>\n<p>      3.    After evaluating the factors and parameters which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict dated 2-12-2010 of the Apex Court in <a href=\"\/doc\/1108032\/\">Siddharam<\/p>\n<p>Satlingappa Mhetre v. State of Maharashtra and Others<\/a><\/p>\n<p>(2010 (4) KLT 930), I am of the view that anticipatory bail<\/p>\n<p>cannot be granted in a case of this nature, since the<\/p>\n<p>investigating officer has not had the advantage of interrogating<\/p>\n<p>the petitioner. But at the same time, I am inclined to permit the<\/p>\n<p>petitioner to surrender before the Investigating Officer for the<\/p>\n<p>purpose of interrogation and then to have his application for bail<\/p>\n<p>considered by the Magistrate or the Court having jurisdiction.<\/p>\n<p>Accordingly,    the    petitioner     shall    surrender      before the<\/p>\n<p>Bail Appln.No.396\/2011<br \/>\n<span class=\"hidden_text\">                                 -2-<\/span><\/p>\n<p>investigating officer on 04\/02\/2011 or on 05\/02\/2011 for the<\/p>\n<p>purpose of interrogation and recovery of incriminating material,<\/p>\n<p>if any. In case the investigating officer is of the view that having<\/p>\n<p>regard to the facts of the case arrest of the petitioner is<\/p>\n<p>imperative he shall record his reasons for the arrest in the case-<\/p>\n<p>diary as insisted in paragraph 129 of Siddharam Satlingappa<\/p>\n<p>Mhetre&#8217;s case (supra).         The petitioner shall thereafter be<\/p>\n<p>produced before the Magistrate or the Court concerned and<\/p>\n<p>permitted to file an application for regular bail. In case the<\/p>\n<p>interrogation of the petitioner is without arresting him, the<\/p>\n<p>petitioner shall thereafter appear before the Magistrate or the<\/p>\n<p>Court concerned and apply for regular bail on the same day or<\/p>\n<p>the next day. The Magistrate or the Court on being satisfied that<\/p>\n<p>the petitioner has been interrogated by the police shall, after<\/p>\n<p>hearing the prosecution as well, consider and dispose of his<\/p>\n<p>application for regular bail preferably on the same date<\/p>\n<p>on which it is filed.\n<\/p>\n<p>      4.     In case the petitioner while surrendering before the<\/p>\n<p>Investigating Officer has deprived        the investigating officer<\/p>\n<p>sufficient time for interrogation, the officer shall complete the<\/p>\n<p>Bail Appln.No.396\/2011<br \/>\n<span class=\"hidden_text\">                                 -3-<\/span><\/p>\n<p>interrogation even if it is beyond the time limit fixed as above<\/p>\n<p>and submit a report to that effect        to the Magistrate or the<\/p>\n<p>Court concerned.
