Jaldhari Sahani son Late Sukhdeo Sahani\n                  both resident of village Loam,\n                  P.S.Sadar, District Darbhanga\n                            Versus\n                          The State Of Bihar\n\n02\/   24.10.2011<\/pre>\n<p>            Heard       Mr.     Ajay       Kumar    Thakur,<\/p>\n<p>                   learned    counsel         for     the     petitioners<\/p>\n<p>                   and learned counsel for the State.<\/p>\n<p>                            The petitioners apprehend their<\/p>\n<p>                   arrest     in    a     case       which     has        been<\/p>\n<p>                   registered           for          offences         under<\/p>\n<p>                   Sections,       307,379           and     some     other<\/p>\n<p>                   Sections of the Indian Penal Code on<\/p>\n<p>                   the allegation that Dilip Sahani was<\/p>\n<p>                   pointing      out      the      pistol,      meanwhile<\/p>\n<p>                   Jaldhari Sahani gave a farsa blow upon<\/p>\n<p>                   the    head       of       the      informant           but<\/p>\n<p>                   informant       tried      to     save himself          but<\/p>\n<p>                   got injury on his finger. Rs.50,000\/-<\/p>\n<p>                   is    alleged     to       have     taken       away    by<\/p>\n<p>                   petitioner no.1.\n<\/p>\n<p>                            Submission          is     that     regarding<br \/>\n<span class=\"hidden_text\">                 2<\/span><\/p>\n<p>injury        upon    the    informant        or      any<\/p>\n<p>person is not mentioned in the case<\/p>\n<p>diary     which       was    available        to      the<\/p>\n<p>petitioner           upto    dated       25.08.2011.<\/p>\n<p>There were two separate fisherman Co-<\/p>\n<p>operative Society and the petitioners<\/p>\n<p>were settlees of disputed society up<\/p>\n<p>to June, 2012 and the allegation of<\/p>\n<p>taking    money       by    petitioner        no.1     is<\/p>\n<p>falsified from the statement of father<\/p>\n<p>of the informant.\n<\/p>\n<p>         Considering           the       facts        and<\/p>\n<p>circumstances          of    the     case,      in     the<\/p>\n<p>event    of     arrest      or surrender         within<\/p>\n<p>twenty        days      from       the     date        of<\/p>\n<p>receipt\/production of a copy of this<\/p>\n<p>order,    the          above    named        both     the<\/p>\n<p>petitioners shall be released on bail<\/p>\n<p>on      furnishing           bail        bonds          of<\/p>\n<p>Rs.10,000\/-(Rupees ten thousand) each<\/p>\n<p>with two sureties of the like amount<\/p>\n<p>each     to    the     satisfaction        of        Chief<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>          Judicial        Magistrate,      Darbhanga   at<\/p>\n<p>          Lheriasarai          in    Darbhanga      Sadar<\/p>\n<p>          P.S.Case No. 298 of 2011 subject to<\/p>\n<p>          the   condition as laid down in Section<\/p>\n<p>          438(2)     of       the   Code    of   Criminal<\/p>\n<p>          Procedure.\n<\/p>\n<p>Tahir\/-                       (Shyam Kishore Sharma, J.)\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Dilip Sahani &amp; Anr. vs The State Of Bihar on 24 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.34616 of 2011 1.
