Justice HARUN-UL-RASHID\n\n Dated :21\/05\/2010\n\n O R D E R\n                     HARUN-UL-RASHID,J.\n             ------------------------------\n                     S.A.NO.438 OF 1997\n            -------------------------------\n                DATED THIS THE 21ST DAY OF MAY, 2010\n\n\n                            JUDGMENT\n<\/pre>\n<p>               Plaintiff in O.S.No.142\/1987 on the file of the<\/p>\n<p>Munsiff&#8217;s Court, Kottarakara is the appellant. The suit was filed<\/p>\n<p>for declaration of title, possession, demarcation of boundary<\/p>\n<p>and for consequential injunction. The suit was decreed in part<\/p>\n<p>declaring his title and possession over the plaint schedule<\/p>\n<p>property having an extent of one acre and 86 cents shown in<\/p>\n<p>Ext.C2 plan as blue shaded plot and that the separating boundary<\/p>\n<p>of the property of the plaintiff and the defendant was fixed as the<\/p>\n<p>EF line and that the defendant is restrained by permanent<\/p>\n<p>prohibitory injunction from trespassing upon the plaint schedule<\/p>\n<p>property shown in Ext.C2 as blue shaded plot, from digging any<\/p>\n<p>foundation pit therein, from constructing foundation basement or<\/p>\n<p>building therein and from committing any acts of waste therein.<\/p>\n<p><span class=\"hidden_text\">                                    -2-<\/span><br \/>\nS.A.438\/1997<\/p>\n<p>According to the plaintiff, the trial court should have declared<\/p>\n<p>title and possession of the red shaded plot shown in Ext.C2 plan<\/p>\n<p>and should have granted consequential injunction. The plaintiff<\/p>\n<p>preferred an appeal for modification of the decree and judgment<\/p>\n<p>to the extent the trial court denies the entire relief sought for in<\/p>\n<p>the plaint.\n<\/p>\n<p>               2.   There is a    delay of 15 days in filing the<\/p>\n<p>appeal, which was accompanied by the delay petition supported<\/p>\n<p>by an affidavit. The Appellate Court dismissed the delay<\/p>\n<p>petition stating that the delay is not satisfactorily<\/p>\n<p>explained. Consequently, the appeal was also dismissed.<\/p>\n<p>               3. The present second appeal is filed against<\/p>\n<p>the dismissal of the appeal by the Lower Appellate Court.<\/p>\n<p>I have gone through the affidavit filed in support of the<\/p>\n<p>petition for condonation of delay and I find that the delay<\/p>\n<p>of 15 days is satisfactorily explained by the appellant.<\/p>\n<p><span class=\"hidden_text\">                              -3-<\/span><br \/>\nS.A.438\/1997<\/p>\n<p>The Lower Appellate Court should have condoned the<\/p>\n<p>delay and the appeal should have been decided on merits.<\/p>\n<p>Since the application for condonation of delay was<\/p>\n<p>dismissed, the appeal was kept pending for a period of<\/p>\n<p>more than 14 years. The reason stated for dismissing the<\/p>\n<p>delay petition is not just and proper in the given<\/p>\n<p>circumstances.\n<\/p>\n<p>             4. In the result, the judgment and decree<\/p>\n<p>passed by the Lower Appellate Court is set aside.<\/p>\n<p>I.A.No.613\/96 filed under section 5 of the Limitation Act<\/p>\n<p>for condonation of delay of 15 days in filing the appeal is<\/p>\n<p>allowed.    The Lower Appellate Court is directed to<\/p>\n<p>dispose of the appeal on merits, after hearing both sides.<\/p>\n<p>The Lower Appellate Court shall issue notice to the<\/p>\n<p>respondent before the matter is taken up for final hearing<\/p>\n<p><span class=\"hidden_text\">                              -4-<\/span><br \/>\nS.A.438\/1997<\/p>\n<p>and shall dispose of the appeal within a period of six<\/p>\n<p>months from the date of receipt of a copy of this<\/p>\n<p>judgment.\n<\/p>\n<p>               Appeal is disposed of as above.
