Justice V.GIRI\n\n Dated :25\/09\/2009\n\n O R D E R\n                          V.GIRI, J\n                        -------------------\n                     W.P.(C).26896\/2008\n                        --------------------\n         Dated this the 25th day of September, 2009\n\n                        JUDGMENT\n<\/pre>\n<p>      Petitioner and the 4th respondent aspire for the post of<\/p>\n<p>Executive Officer in the         Oorpazhassikkavu Devaswom.<\/p>\n<p>Petitioner had sent a complaint against the selection of the<\/p>\n<p>4th respondent to the 2nd respondent.          While so, the 4th<\/p>\n<p>respondent was suspended and he challenged the order of<\/p>\n<p>suspension before this Court.              This Court by Ext.P7<\/p>\n<p>judgment, directed the 1st respondent therein namely the<\/p>\n<p>Commissioner     of     Hindu        Religious   and  Charitable<\/p>\n<p>Endowments Department, to consider the request made by<\/p>\n<p>the petitioner therein for revocation of his suspension. By<\/p>\n<p>Ext.P8 order, the Commissioner directed that the suspension<\/p>\n<p>be revoked. But at the same time, the appointment of the 4th<\/p>\n<p>respondent is also directed to be approved. This has been<\/p>\n<p>challenged in the writ petition.\n<\/p>\n<\/p>\n<p>2.    A counter affidavit has been filed on behalf of the 1st<\/p>\n<p>respondent, the Commissioner. One of the contentions taken<\/p>\n<p>up is Ext.P8 order is revisable by the Government under<\/p>\n<p>Section 99 of the HR &amp; CE Act.\n<\/p>\n<p>W.P.(C).26896\/08<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>3.    I heard learned counsel for the petitioner, learned<\/p>\n<p>Government Pleader and learned counsel appearing for the<\/p>\n<p>Malabar Devaswom.\n<\/p>\n<\/p>\n<p>4.    Learned counsel for the petitioner submits that the<\/p>\n<p>direction issued by this Court in Ext.P7 was only to consider<\/p>\n<p>the request made by the 4th respondent for revocation of<\/p>\n<p>suspension. The Commissioner had travelled away beyond<\/p>\n<p>the scope of the application by proceeding to approve the<\/p>\n<p>appointment of the 4th respondent.      This is ignoring the<\/p>\n<p>complaint filed by the petitioner challenging the selection of<\/p>\n<p>the 4th respondent. The net result is that the petitioner has<\/p>\n<p>been deprived of an opportunity to impugn the selection of<\/p>\n<p>the 4th respondent.\n<\/p>\n<\/p>\n<p>5.    It is true that the Commissioner has proceeded not<\/p>\n<p>only to revoke the suspension but also pass an order<\/p>\n<p>approving the appointment of the 4th respondent. But the<\/p>\n<p>petitioner has a remedy before the Government, against<\/p>\n<p>Ext.P8, under Section 99 of the Act. Though learned counsel<\/p>\n<p>for the petitioner expresses a doubt as to whether the said<\/p>\n<p>W.P.(C).26896\/08<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>power can be exercised on an application, I do not think<\/p>\n<p>there is any reason to be apprehensive. The power can be<\/p>\n<p>exercised on application also. Learned Government Pleader<\/p>\n<p>and learned counsel for the Devaswom Board also affirm<\/p>\n<p>this position.\n<\/p>\n<\/p>\n<p>6.    Petitioner may file a revision against Ext.P8 within four<\/p>\n<p>weeks from today.       If it is so done,   Government shall<\/p>\n<p>proceed to entertain the revision on merits and dispose of<\/p>\n<p>the same considering the petitioner&#8217;s contentions, as regards<\/p>\n<p>the correctness of the order passed by the Commissioner<\/p>\n<p>approving the appointment of the 4th respondent, on an<\/p>\n<p>application filed by the 4th respondent, for revocation of<\/p>\n<p>suspension.
