Dave was<br \/>\n\tappearing as Standing Counsel who has been elevated as a Judge in<br \/>\n\tthe Bench of this Court and, thereafter, notices were issued to the<br \/>\n\tappellant by this Court informing the appellant that the Standing<br \/>\n\tCounsel appearing for them has been elevated as a Judge to the Bench<br \/>\n\tof this Court and, therefore, they shall have to remain personally<br \/>\n\tpresent or to engage another advocate to appear on their behalf.<br \/>\n\tCause list indicates that the notices issued by this court to the<br \/>\n\tappellant have not been received back but no steps have been taken<br \/>\n\teither by the Registry or any other responsible person. The<br \/>\n\tappellant is the Government of India through Director General of<br \/>\n\tSecurity and though sufficient time has gone, yet the notices have<br \/>\n\tnot been received back.\n<\/p>\n<p>In<br \/>\n\tFirst Appeal No. 2117\/04 to First appeal No. 2121 of 2004, arising<br \/>\n\tfrom MACP No. 364\/95; 67\/95; 66\/95; 65\/95 and 241\/95, the appellant<br \/>\n\tis challenging the award of small and petty amounts of Rs.19,800\/-;<br \/>\n\tRs.15000\/-; Rs.2500\/-; Rs.3000\/- and Rs.11000\/- respectively.\n<\/p>\n<p>Therefore,<br \/>\n\tconsidering two facts, one is that these are the matters of 2004<br \/>\n\twherein  notices issued by this court to the appellant have not been<br \/>\n\treceived back and in five appeals, amount involved is small, award<br \/>\n\tof petty amount has been challenged by the appellant, therefore,<br \/>\n\taccording to my opinion, since the appellant is challenging award of<br \/>\n\tpetty amount in First Appeal No. 2117 of 2004 to 2121 of 2004, those<br \/>\n\tappeals are required to be disposed of by this court without<br \/>\n\texpressing any opinion on merits of the appeals and in First Appeal<br \/>\n\tNo. 2116 of 2004, since the appellant is challenging the award of<br \/>\n\tRs.2,58,000.00, since the notices issued by this court have yet not<br \/>\n\tbeen received back, fresh notices are required tobe issued to the<br \/>\n\tappellant.\n<\/p>\n<p>Therefore,<br \/>\n\tin First Appeal No. 2116 of 2004 arising out of the award in MACP<br \/>\n\tNo. 118 of 1995, and Civil Application No. 7265 of 2004 filed in the<br \/>\n\tsaid appeal, issue fresh notice to the appellant Government of India<br \/>\n\tthrough Director General of Security, c\/o. SSB  (Sp. Security<br \/>\n\tBureau) PB NO. 18, Jamnagar returnable on1st September, 2008.\n<\/p>\n<p>First<br \/>\n\tAppeal No. 2117 of 2004 to 2121 of 2004 are disposed of without<br \/>\n\texpressing any opinion on merits as the amount involved therein is<br \/>\n\tsmall and petty amount.\n<\/p>\n<p>In<br \/>\n\tappeals which have been disposed of by this court considering the<br \/>\n\tinvolvement of petty amount, appellant is directed to deposit the<br \/>\n\tsaid amounts as awarded by the claims tribunal if it has not been<br \/>\n\tdeposited by the appellant so far before the claims tribunal<br \/>\n\tconcerned with interest and costs within one month from the date of<br \/>\n\treceipt of copy of this order. After the amounts are realized by the<br \/>\n\tclaims tribunal from the appellant in the aforesaid appeals<br \/>\n\tdismissed by this court, it is directed to the claims tribunal to<br \/>\n\tmake payment of the amount to the respective respondents claimants<br \/>\n\tby way of an account payee cheque without any delay.\n<\/p>\n<p>In<br \/>\n\tFA No. 2116\/04 to 2121\/04  with CA NO. 7265 to 7270 of 2004,<br \/>\n\tfollowing order was passed by this Court on 10.9.2004:\n<\/p>\n<p>?S<br \/>\n\tORDER<br \/>\n\tON APPEAL :\n<\/p>\n<blockquote><p>      Admit.<\/p>\n<p>      ORDER ON CIVIL APPLICATION :<\/p><\/blockquote>\n<p>      \tRule.  Subject to deposit  of  the  award  amount<br \/>\n      with the Claims Tribunal concerned within two months, the<br \/>\n      award shall  remain  stayed.  The amount deposited in the<br \/>\n      Registry of this Court under section  173  of  the  Motor<br \/>\n      Vehicles  Act,  1988  be  transmitted to the MAC Tribunal<br \/>\n      concerned which will invest both the amounts in FDRs with<br \/>\n      the Nationalized Bank for a period of three years in  the<br \/>\n      first instance extendable in case the appeal is not heard<\/p>\n<p>\twithin<br \/>\n\tthis period.??\n<\/p>\n<p>Therefore,<br \/>\n\tin First Appeal No. 2116 of 2004, claims tribunal is directed to pay<br \/>\n\t30 per cent of the amount to the respondent claimant by account<br \/>\n\tpayee cheque and remaining 70 per cent amount is ordered to be<br \/>\n\tinvested in any nationalized bank initially for a period of five<br \/>\n\tyears with cumulative interest with periodical renewal in the name<br \/>\n\tof the respondent claimant and the FDRs shall remain in the custody<br \/>\n\tof the Nazir of the claims tribunal concerned and the respondent<br \/>\n\tclaimants will not be entitled to any amount of interest accruing on<br \/>\n\tthose FDRs till the first appeal no. 2116 of 2004 is decided by this<br \/>\n\tcourt finally.\n<\/p>\n<p>Rest<br \/>\n\tof the Civil Applications No. 7266 to 7270 of 2004 in First Appeal<br \/>\n\tNo. 2117 to 2121 of 2004 are disposed of in view of the orders<br \/>\n\tpassed by this Court in those main matters.\n<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Government vs Sarlaben on 1 August, 2008 Author: H.K.Rathod,&amp;Nbsp;
