P1 to P4 orders passed under Section<\/p>\n<p>14B of the       Employees        Provident Fund &amp; Miscellaneous<\/p>\n<p>Provisions Act 1952, the petitioner filed Exts. P5 to P8 appeals<\/p>\n<p>before the 2nd respondent-Tribunal. The petitioner&#8217;s grievance<\/p>\n<p>in this writ petition is that even before the period prescribed in<\/p>\n<p>the Act for preferring appeals was over, the 1st respondent has<\/p>\n<p>initiated coercive proceedings for recovery of the amount<\/p>\n<p>demanded as per the orders impugned in the appeals.           The<\/p>\n<p>petitioner submits that this is arbitrary and unsustainbale. The<\/p>\n<p>petitioner, therefore, seeks stay of coercive recovery proceedings<\/p>\n<p>pursuant to the orders impugned in the appeal till disposal of the<\/p>\n<p>appeal.\n<\/p>\n<p>      2.   I have heard the learned standing counsel appearing<\/p>\n<p>for the organisation also. Under the Act, the petitioner has got a<\/p>\n<p>right to move the tribunal for stay of recovery of the amounts<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.35916\/2007                   -2-<\/span><\/p>\n<p>covered by the orders in appeal.         That being so, it is only<\/p>\n<p>appropriate that the 1st respondent keeps coercive recovery<\/p>\n<p>proceedings      in abeyance till the tribunal considers and passes<\/p>\n<p>orders on the interim prayer of the petitioner in the appeals. In<\/p>\n<p>the circumstances, this writ petition is disposed of with a<\/p>\n<p>direction to the 2nd respondent to consider the petitioner&#8217;s<\/p>\n<p>prayer for interim relief on Exts. P5 to P8 appeals as<\/p>\n<p>expeditiously as possible. Till orders are passed on the interim<\/p>\n<p>prayers, further coercive proceedings pursuant to Exts.
