BASANT, J.\n          ````````````````````````````````````````````````````\n                  B.A. No. 2096 OF 2008 F\n          ````````````````````````````````````````````````````\n            Dated this the 4th day of April, 2008\n\n                            O R D E R\n<\/pre>\n<p>          Application for anticipatory bail.          Petitioner faces<\/p>\n<p>indictment in a prosecution under the Kerala Abkari Act. He<\/p>\n<p>was allegedly found to be in possession of 10 x 375 ml of<\/p>\n<p>IMFL on 29.1.02. The petitioner was not arrested at the crime<\/p>\n<p>stage or thereafter. Investigation is complete. Final report<\/p>\n<p>has already been filed.           Cognizance has been taken.<\/p>\n<p>Committal proceedings has been registered. Reckoning the<\/p>\n<p>petitioner as an absconding accused, coercive processes<\/p>\n<p>have been issued against the petitioner. The petitioner finds<\/p>\n<p>such processes chasing him now. He apprehends imminent<\/p>\n<p>arrest.\n<\/p>\n<p>      2.  According to the petitioner, he is absolutely<\/p>\n<p>innocent. His absence earlier was not wilful or deliberate. He<\/p>\n<p>had no knowledge about the proceedings initiated against<\/p>\n<p>him. The petitioner is willing to surrender before the learned<\/p>\n<p>Magistrate and seek regular bail. But he apprehends that his<\/p>\n<p>application for bail may not be considered by the learned<\/p>\n<p>BA.2096\/08<br \/>\n<span class=\"hidden_text\">                                 : 2 :<\/span><\/p>\n<p>Magistrate    on    merits,    in   accordance  with  law    and<\/p>\n<p>expeditiously.    He, therefore, prays that directions under<\/p>\n<p>Section 438 or 482 Cr.P.C. may be issued to the learned<\/p>\n<p>Magistrate to release the petitioner on bail when he appears<\/p>\n<p>and applies for bail.\n<\/p>\n<p>      3.   After the decision in Bharat Chaudhary and<\/p>\n<p>another Vs. State of Bihar [AIR 2003 SC 4662], it is now trite<\/p>\n<p>that powers under section 438 Cr.P.C. can be invoked in<\/p>\n<p>favour of a person who apprehends arrest in execution of a<\/p>\n<p>non-bailable warrant issued by a court in a pending<\/p>\n<p>proceedings.     But even for that, sufficient and satisfactory<\/p>\n<p>reasons must be shown to exist. I am not persuaded, in the<\/p>\n<p>facts and circumstances of this case, that any such reasons<\/p>\n<p>exist.\n<\/p>\n<p>      4.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate, the<\/p>\n<p>circumstances under which he could not earlier appear before<\/p>\n<p>the learned Magistrate. I find absolutely no reason to assume<\/p>\n<p>that the learned Magistrate would not consider the application<\/p>\n<p>BA.2096\/08<br \/>\n<span class=\"hidden_text\">                               : 3 :<\/span><\/p>\n<p>for bail to be filed by the petitioner on merits, in accordance<\/p>\n<p>with law and expeditiously. Every court must do the same.<\/p>\n<p>No special or specific directions appear to be necessary.<\/p>\n<p>Sufficient general directions have been issued in Alice<\/p>\n<p>George Vs. Deputy Superintendent of Police [2003 (1) KLT<\/p>\n<p>339].\n<\/p>\n<p>     5.    In the result, this petition is dismissed but with the<\/p>\n<p>specific observation that if the petitioner surrenders before the<\/p>\n<p>learned Magistrate and applies for bail, after giving sufficient<\/p>\n<p>prior notice to the Prosecutor in charge of the case, the<\/p>\n<p>learned Magistrate must proceed to pass appropriate orders<\/p>\n<p>on merits, in accordance with law and expeditiously &#8211; on the<\/p>\n<p>date of surrender itself.\n<\/p>\n<p>     6.    Needless to say, the claim of the petitioner for bail<\/p>\n<p>has to be considered by the learned Magistrate in the light of<\/p>\n<p>the decision reported in Sukumari Vs.
