JUSTICE GOPAL KRISHAN VYAS\n    _________________________________________\n\n\nMr. Vineet Kumar Mathur for the petitioners.\nMr. Vijay Mehta for the respondent.\n\n\nBY THE COURT : (Per Hon'ble Mr. Vyas, J.)<\/pre>\n<p>        This writ petition has been filed by the Union of<\/p>\n<p>India      through    the     Secretary,      Ministry   of<\/p>\n<p>Communication, Department of Posts, and, Assistant<\/p>\n<p>Superintendent of Post Officer, Sub Division, Kankroli<\/p>\n<p>(Rajsamand), in which, the petitioners are challenging<\/p>\n<p>the validity of order dated 20.03.2009 passed by the<\/p>\n<p>Central     Administrative   Tribunal,     Jodhpur   Bench,<\/p>\n<p>Jodhpur, by which, the Original Application filed by<\/p>\n<p>respondent Chandresh Kumar @ Chunni Lal against his<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>termination order dated 28.03.2007 was allowed by the<\/p>\n<p>Tribunal.    The main contention of learned counsel for<\/p>\n<p>the petitioners is that the order of the learned Tribunal<\/p>\n<p>is erroneous because the services of respondent was<\/p>\n<p>terminated on the ground that incompetent authority<\/p>\n<p>had offered appointment to the respondent-applicant<\/p>\n<p>under the relaxation of recruitment rules, therefore,<\/p>\n<p>order of appointment issued by the said officer is ab<\/p>\n<p>initio null and void.     Further, it is argued that the CRC<\/p>\n<p>rejected the case of the applicant for compassionate<\/p>\n<p>appointment     on      15.09.2005     and     the   same   was<\/p>\n<p>communicated      to     the   respondent      on    14.10.2005,<\/p>\n<p>against which, Original Application was preferred but<\/p>\n<p>the same was dismissed as pre-mature.<\/p>\n<p>      Learned    counsel       for   the   petitioners   further<\/p>\n<p>contended that mention of Rule 6 of the earlier rules<\/p>\n<p>does not vitiate the order as provisions of Rule 8 are<\/p>\n<p>identical.     Therefore, a patent illegality has been<\/p>\n<p>committed by the learned Tribunal while quashing the<\/p>\n<p>order of termination dated 28.03.2007 and, further, in<\/p>\n<p>passing order for reinstatement in service with all<\/p>\n<p>consequential benefits.\n<\/p>\n<p>      Per    contra,     learned     counsel    appearing    for<\/p>\n<p>respondent Chandresh Kumar @ Chunni Lal vehemently<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>argued that the order impugned has been passed while<\/p>\n<p>exercising power provided under Rule 6 of the G.D.S.<\/p>\n<p>(Conduct &amp; Service) Rules; but, upon perusal of said<\/p>\n<p>Rule 6 (Rule 8 of the new Rules), it appears that<\/p>\n<p>services cannot be terminated under old Rule 6 and<\/p>\n<p>new Rule 8 if the employee has worked for more than<\/p>\n<p>three years.\n<\/p>\n<p>     It is also argued that before passing of the order<\/p>\n<p>of termination, no opportunity of hearing was given and<\/p>\n<p>no reasons were assigned in the order for terminating<\/p>\n<p>the services of respondent-applicant.    Therefore, the<\/p>\n<p>learned Tribunal, while following the earlier decision<\/p>\n<p>rendered in the case of Dinesh Chandra Vyas Vs. Union<\/p>\n<p>of India, in which, Rule 6 and new Rule 8 were<\/p>\n<p>considered, has rightly allowed the original application<\/p>\n<p>of the respondent-applicant, in which, there is no error<\/p>\n<p>apparent.      Hence, this writ petition deserves to be<\/p>\n<p>dismissed.\n<\/p>\n<p>     We have heard learned counsel for the parties.<\/p>\n<p>     Upon perusal of the termination order of the<\/p>\n<p>applicant, it appears that the said order was passed<\/p>\n<p>while exercising power under proviso to Rule 6(b) and<\/p>\n<p>note below Rule 6 (b) of the G.D.S. (Conduct &amp; Service)<\/p>\n<p>Rules, 1964, which was subsequently amended and new<br \/>\n<span class=\"hidden_text\">                            4<\/span><\/p>\n<p>Rule 8 came into force.    For the sake of convenience,<\/p>\n<p>both Rule 6 of the old Rules and Rule 8 of the new<\/p>\n<p>Rules are re-produced below :\n<\/p>\n<p>EDA (Conduct &amp; Service) Rules, 1964<\/p>\n<p>       &#8220;6.Termination of Services.-(a) The<br \/>\n       services of an employee who has not<br \/>\n       already rendered more than three years&#8217;<br \/>\n       continuous service from the date of his<br \/>\n       appointment shall be liable to termination<br \/>\n       at any time by a notice in writing given<br \/>\n       either by the employee to the appointing<br \/>\n       authority or by the appointing authority to<br \/>\n       the employee;\n<\/p>\n<p>       (b) The period of such notice shall be one<br \/>\n       month :\n<\/p>\n<p>             Provided that the service of any<br \/>\n       such employee may be terminated<br \/>\n       forthwith and on such termination, the<br \/>\n       employee shall be entitled to claim a sum<br \/>\n       equivalent to the amount of his basic<br \/>\n       allowance plus Dearness Allowance for the<br \/>\n       period of the notice at the same rates at<br \/>\n       which he was drawing them immediately<br \/>\n       before the termination of his services, or,<br \/>\n       as the case may be, for the period by<br \/>\n       which such notice falls short of one<br \/>\n       month.\n<\/p>\n<p>       NOTE.-Where the intended effect of such<br \/>\n       termination has to be immediate, it<br \/>\n       should be mentioned that one month&#8217;s<br \/>\n       basic allowance plus Dearness Allwance is<br \/>\n       being remitted to the ED Agent in lieu of<br \/>\n       the notice of one month through money<br \/>\n       order.&#8221;\n<\/p>\n<p>GDS Conduct &amp; Employment) Rules, 2001<\/p>\n<p>       &#8220;8.Termination of Employment.-(1)<br \/>\n       The employment of a Sevak who has not<br \/>\n       already rendered more than three years&#8217;<br \/>\n<span class=\"hidden_text\">                           5<\/span><\/p>\n<p>      continuous employment from the date of<br \/>\n      his appointment shall be liable to<br \/>\n      termination at any time by a notice in<br \/>\n      writing given either by the Sevak to the<br \/>\n      Appointing Authority or by the Appointing<br \/>\n      Authority to the Sevak;\n<\/p>\n<p>      (2) The period of such notice shall be one<br \/>\n      month:\n<\/p>\n<p>            Provided that the employment of<br \/>\n      any such Sevak may be terminated<br \/>\n      forthwith and on such termination, the<br \/>\n      Sevak shall be entitled to claim a sum<br \/>\n      equivalent to the amount of Basic Time<br \/>\n      Related    Continuity    Allowance   plus<br \/>\n      Dearness Allowance as admissible for the<br \/>\n      period of notice at the same rates at<br \/>\n      which he was drawing them immediately<br \/>\n      before the termination of his employment,<br \/>\n      or, as the case may be, for the period by<br \/>\n      which such notice falls short of one<br \/>\n      month.\n<\/p>\n<p>      NOTE.-Where the intended effect of such<br \/>\n      termination has to be immediate, it should<br \/>\n      be mentioned that one month&#8217;s Time<br \/>\n      Related    Continuity   Allowance     plus<br \/>\n      Dearness Allowance as admissible is being<br \/>\n      remitted to the Sevak in lieu of notice of<br \/>\n      one month through money order.&#8221;\n<\/p>\n<p>\n     Upon perusal of Rule 8, it is obvious that the<\/p>\n<p>employment of a Sevak who has not already rendered<\/p>\n<p>three years&#8217; continuous employment from the date of<\/p>\n<p>his first appointment can be terminated at any time by<\/p>\n<p>a notice in writing given either by Sevak to the<\/p>\n<p>appointing authority or by the appointing authority to<\/p>\n<p>the Sevak.      Here, in this case, admittedly, the<br \/>\n<span class=\"hidden_text\">                              6<\/span><\/p>\n<p>respondent     was    appointed    on   03.01.2001     and<\/p>\n<p>termination order was passed on 28.03.2007, which is<\/p>\n<p>after   three years, therefore, the learned Tribunal<\/p>\n<p>passed the following order :\n<\/p>\n<blockquote><p>         &#8220;10. Coming to the facts of this case, we<br \/>\n         find that the services of the applicant has<br \/>\n         been terminated after more than 3 years.<br \/>\n         This could not have been done by invoking<br \/>\n         the powers mentioned in the termination<br \/>\n         order.    The impugned order is therefore<br \/>\n         quashed and set aside.       The applicant<br \/>\n         shall be reinstated in service and will be<br \/>\n         entitled to consequential benefits.    This<br \/>\n         order shall not stand in the way of<br \/>\n         respondents taking action under other<br \/>\n         provisions of the Rules.        The order<br \/>\n         regarding reinstatement shall be passed<br \/>\n         as expeditiously as possible and preferably<br \/>\n         within one month of the receipt of the<br \/>\n         order.     No costs.    Thus, this O.A. Is<br \/>\n         disposed off&#8221;<\/p><\/blockquote>\n<p>        We have perused the judgment impugned.          In<\/p>\n<p>our opinion, the order passed by the learned Tribunal is<\/p>\n<p>perfectly in consoance with the provisions of law in view<\/p>\n<p>of the fact that before passing the order impugned no<\/p>\n<p>opportunity of hearing was given to the respondent-<\/p>\n<p>applicant which is mandatory in view of the judgment of<\/p>\n<p>the Hon&#8217;ble Supreme Court rendered in the case of D.K.<\/p>\n<p>Yadav    Vs. J.M.A. Industries Ltd., 1993 SCC (L&amp;S)<\/p>\n<p>723, in which, the Hon&#8217;ble Supreme Court has<\/p>\n<p>expressly laid down in para 9 of the judgment as<\/p>\n<p>follows :\n<\/p>\n<p><span class=\"hidden_text\">                             7<\/span><\/p>\n<blockquote><p>              &#8220;9. It is a fundamental rule of law<br \/>\n       that no decision must be taken which<br \/>\n       will affect the right of any person<br \/>\n       without first being informed of the case<br \/>\n       and giving him\/her an opportunity of<br \/>\n       putting forward his\/her case. An order<br \/>\n       involving civil consequences must be<br \/>\n       made consistently with the rules of<br \/>\n       natural justice. In Mohinder Singh Gill<br \/>\n       v. Chief Election Commissioner the<br \/>\n       Constitution Bench held that &#8216;civil<br \/>\n       consequences&#8217; covers infraction of not<br \/>\n       merely property or personal right but<br \/>\n       of civil liberties, material deprivations<br \/>\n       and non-pecuniary damages.          In its<br \/>\n       comprehensive connotation every thing<br \/>\n       that affects a citizen in his civil life<br \/>\n       inflicts a civil consequence.      Black&#8217;s<br \/>\n       Law Dictionary, 4th edn., page 1487<br \/>\n       defined civil rights are such as belong<br \/>\n       to every citizen of the state or<br \/>\n       country &#8230; they include &#8230; rights<br \/>\n       capable of being enforced or redressed<br \/>\n       in a civil action &#8230;.. <a href=\"\/doc\/1455346\/\">In State of Orissa<br \/>\n       v. (Miss) Binapani Dei<\/a> this Court held<br \/>\n       that even an administrative order<br \/>\n       which involves civil consequences must<br \/>\n       be made consistently with the rules of<br \/>\n       natural justice. The person concerned<br \/>\n       must be informed of the case, the<br \/>\n       evidence in support thereof supplied<br \/>\n       and must be given a fair opportunity to<br \/>\n       meet the case before an adverse<br \/>\n       decision is taken.        Since no such<br \/>\n       opportunity was given it was held that<br \/>\n       superannuation was in violation of<br \/>\n       principles of natural justice.&#8221;\n<\/p><\/blockquote>\n<p>In our opinion, the learned Tribunal has not committed<\/p>\n<p>any error while allowing the original application filed by<\/p>\n<p>respondent before the Tribunal, therefore, there is no<br \/>\n<span class=\"hidden_text\">                                8<\/span><\/p>\n<p>force in this writ petition.
