RAJENDRA MISHRA,    ASSISTANT TEACHER, CHHITAWNA, MEMBER PANCHAYAT NIYOJAN\nSAMITI, PANCHAYAT RAJ, KHALGAON, P.S- KATEYA, DISTT- GOPALGANJ\n                                                 -----------\n<\/pre>\n<p>2\/    19\/04\/2011                From the record as it stands, the petitioner is<\/p>\n<p>                     aggrieved by a recommendation dated 6.10.2009 made by<\/p>\n<p>                     the District Magistrate recommending his removal from the<\/p>\n<p>                     post of Mukhiya addressed to the Commissioner.<\/p>\n<p>                                Earlier it was the Commissioner and now it is the<\/p>\n<p>                     State Government which has been vested with the statutory<\/p>\n<p>                     power to be exercised in a manner prescribed in the Statute<\/p>\n<p>                     after   giving   of   a   show   cause    notice   and   adequate<\/p>\n<p>                     opportunity for defence to the person concerned.<\/p>\n<p>                                A mere recommendation does not amount to<\/p>\n<p>                     removal by the statutory authority.\n<\/p>\n<p>                                The    writ    application     is   premature.
