Plainti\ufb01s respondents&#8217;<\/p>\n<p> suit for ejectment has been deemed by both the courts<\/p>\n<p>below.\n<\/p>\n<p>\ufb02y<\/p>\n<p>2. During the course of this judglraerlt&#8230;<br \/>\nwould be referred to with reference to   <\/p>\n<p>trial court.\n<\/p>\n<p>3. Facts leading to  of&#8221;  can <\/p>\n<p>summarised asfollo\ufb01ys:  ,<br \/>\nThe plainuira    possession in<br \/>\nrespect of  The case or the<br \/>\n       was a tenant in<\/p>\n<p>   property. The rate of<br \/>\nrent was Rs.  The plainti\ufb02il need the suit<br \/>\n  honaiide use and occupation. Hence,<\/p>\n<p>2 *  .  issued on 30.12.2002 calling upon<\/p>\n<p>   vacate the said premises. That was not<\/p>\n<p>done.  the said suit is \ufb01led.<\/p>\n<p>K _    The defendant has contested the proceedings by<br \/>\n   the written statement admitting that he is a tenant<\/p>\n<p>under the plaintiifs on a monthly rent of Rs. 300\/-; but<br \/>\nthe other allegations am denied. It is the case of the<\/p>\n<p>defendant that the father of the plaint\ufb02fs was  the<br \/>\nadvance amount of Rs. 30,000\/- to one  H T   But<\/p>\n<p>however the father of the ptainette  to  <\/p>\n<p>Therefore, the father of the      J<\/p>\n<p>32,000\/- ae advance   let&#8221;the<br \/>\npremises to the   rent of Rs.<br \/>\n200\/-. Hence, he wound   plainti\ufb02e me not<\/p>\n<p>entitled for   I<\/p>\n<p>5.   trial, the eeeond plaintuf<br \/>\n A  &#8221; and the son of the onginnl&#8217;<br \/>\ndefend\u00e9&#8217;ntV_&#8217;wae~.  as DW.1. Exs.P.1 to PA were<\/p>\n<p> on  the pmtntme and Exs.D. 1 0.226 were<\/p>\n<p>%   of the defendant. The learned trial<\/p>\n<p>&#8221;    consideration of the evidence has recorded a<\/p>\n<p> A T\ufb01xidjngthatthe termination notice is properand ithas<\/p>\n<p>  sewed on the original defendant. H  V<\/p>\n<p>7. I have  deaees of both<\/p>\n<p>3.
