\nplaintiff approached the plaintiff Bank for credit facility in
\nconnection with business for installing Xerox vnilachine
\nwith accessories and the second H
\nguarantor. The plaintiff Bank sanctioned_RsfSw3,:ti–7f5..\/ .V
\n20-ll~1996. The loan documents
\nfirst defendant. The second .defenda’nt”exec1.itlegi.
\nguarantee on 25–l~l99’7.    defendant
\ncommitted default, as isstied to first<\/p>\n

 present appellant appeared and \ufb01led<\/p>\n
his wlrittenisgtatement denying the claim of the plaintiff in<\/p>\n

\nsubmitted that the date of signature of the witness is
\ntaken on 22.11.1996 as such. the evidence produced by<\/p>\n

admitting having borrowed Rs.93.575\/–.  <\/p>\n

Ex.P.3 clearly stipulates that  hasbeen sanctioned

\nindicatespthat  had undertaken to repay<\/p>\n
the loan of  Vin the event of the first defendant<\/p>\n

;EvetTerr.dant’ No.2 by entering into the Witness<\/p>\n
box.\u00bb._44:lt isno-tiffnthe case of Defendant No.2 that he was<\/p>\n
‘unaWare__f*of the proceedings. He was served with suit
\nA   and he had appeared before the Trial Court and<\/p>\n
   was examined. Thereafter, the matter was posted<\/p>\n

\nappear on that day. It is in these circumstances. the Trial<\/p>\n
Court posted the matter for argument and relyingjon the<\/p>\n

that there is nothing to disbelieve these  <\/p>\n
decreed the suit. Defendant No.1 <\/p>\n
contest the matter and though \u00ab’Defendar:1tii\\Zo.2′:’; <\/p>\n
written statement, does not crosstdexamine. 1 and there
\nis no evidence led by  _\n<\/p>\n
9. In these circumstances, I”.’doV’iiiot’V”find that there<\/p>\n
is any the Trial Court in decreeing the<\/p>\n
suit of theiplaindtiffaf :1 do not find it necessary to<\/p>\n
 issue; ‘fresh notice ‘to the unserved respondents.<\/p>\n
