Pandey, learned counsel for the petitioner.\n      Ms. Jailakshmi Aiyer, learned counsel for respondent<\/pre>\n<p>State.\n<\/p>\n<p>      Heard on the question of admission.\n<\/p>\n<p>      Petitioner by way of present petition under Article 226<br \/>\nof   the   Constitution     of   India   calls    in   question   the<br \/>\ncorrectness of order dated 8.12.2006; whereby, the claim of<br \/>\nthe petitioner for reinstatement and payment of wages has<br \/>\nbeen declined.        The petitioner was initially engaged as<br \/>\ncontingent worker vide order dated 31.3.2002. Subsequent<br \/>\nthereof the services were dispensed with as no more<br \/>\nrequired vide order dated 20.11.2002.\n<\/p>\n<p>      The petitioner questioned the said order in W.P. No.<br \/>\n10229\/2006 (s). The said writ petition was disposed of by<br \/>\norder dated 30.8.2006 in the light of the common order<br \/>\npassed in W.P. No. 12138\/2006 (s) &#8211; Smt. Koushalya Saket<br \/>\nv. State of M.P. and another which was disposed of with the<br \/>\ndirection that:\n<\/p>\n<blockquote><p>     &#8220;Order of termination of service of the petitioner<br \/>\n     whose services have been terminated without<br \/>\n     compliance of Section 25-F of the Industrial<br \/>\n     Disputes Act is held to be illegal and void.<br \/>\n     Respondents are at liberty to take steps in<br \/>\n     accordance with law. No costs.&#8221;<\/p><\/blockquote>\n<p>      It   is   in   pursuance   to   aforesaid    order   that   the<br \/>\nimpugned order dated 8.12.2006 has been passed.\n<\/p>\n<p>      Present petition when it was taken up for hearing on<br \/>\nadmission on 13.3.2009, learned counsel appearing for the<br \/>\nState of M.P. informed that against the order dated 30 th<br \/>\n<span class=\"hidden_text\">                                                 2<\/span><\/p>\n<p>                 August 2006 passed in W.P. No. 10229\/2006 (S), a Writ<br \/>\n                 Appeal No. 177\/2007 is pending before the Division Bench<br \/>\n                 in which the interim order has been passed.        The petition<br \/>\n                 was   thereafter   adjourned   and   posted   on    27.8.2010;<br \/>\n                 whereon, the same was adjourned at the instance of<br \/>\n                 learned counsel for the parties to ascertain as to whether<br \/>\n                 W.A. No. 177\/2007 is against the order passed in W.P. No.<br \/>\n                 10229\/2006.\n<\/p>\n<p>                       The matter when, it is taken up today, it is submitted<br \/>\n                 on behalf of respondent State that since the common order<br \/>\n                 passed in W.P. No. 12138\/2006 (S) is the subject matter of<br \/>\n                 W.A. No. 177\/2007 and the operation of order passed<br \/>\n                 therein has been stayed, no relief for the present can be<br \/>\n                 granted to the petitioner as the impugned order dated<br \/>\n                 8.12.2006 is in compliance to order passed in W.P. No.<br \/>\n                 12138\/2006 (S).\n<\/p>\n<p>                       In view of peculiar facts of present case, since no<br \/>\n                 relief can at present be granted till the pendency of W.A.<br \/>\n                 No. 177\/2007, the petition is disposed of with the liberty to<br \/>\n                 the petitioner to revive the petition in case W.A.
