No.14925 of 2011\n                                      Himadri Datta\n                                           Versus\n                                   The State Of Bihar\n                                         -----------\n<\/pre>\n<p>3   28-07-2011              Heard learned counsel for the petitioner as well as<\/p>\n<p>                 learned Additional Public Prosecutor for the state.<\/p>\n<p>                            Admittedly, the dead body of a woman wrapped in a<\/p>\n<p>                 blanket, was found near Ganga Bandh and after recovery of the<\/p>\n<p>                 aforesaid dead body, Naya Ramnagar (Safiasarai) P.S. Case<\/p>\n<p>                 No. 13 of 2009 under Sections-302\/34, 201 of the Indian Penal<\/p>\n<p>                 Code was registered against unknown persons. The police after<\/p>\n<p>                 completion of investigation submitted final form showing &#8220;the<\/p>\n<p>                 case true but not clue&#8221;. After submission of the aforesaid final<\/p>\n<p>                 form, the I.O. prayed before the Chief Judicial Magistrate,<\/p>\n<p>                 Munger to reinvestigate the case and subsequently, statement of<\/p>\n<p>                 father of the petitioner and two neighbours, was recorded and<\/p>\n<p>                 father of the petitioner stated that the deceased was killed by<\/p>\n<p>                 petitioner and his other associates.\n<\/p>\n<p>                            The contention of learned counsel for the petitioner is<\/p>\n<p>                 that the father of the petitioner has already filed an affidavit<\/p>\n<p>                 before Chief Judicial Magistrate, Munger denying his statement<\/p>\n<p>                 said to be recorded under section-161 of the Cr.P.C. It is further<\/p>\n<p>                 contended by him that except the statement of father of the<\/p>\n<p>                 petitioner, there is nothing in the entire case diary to show the<\/p>\n<p>                 involvement of the petitioner in commission of murder of his wife.<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>                   Considering the aforesaid submissions as well as<\/p>\n<p>        facts and circumstances of the case, I do not feel it proper to<\/p>\n<p>        release the petitioner on bail.
