SANKARAN, J.\n                    ---------------------------\n                     B.A. No. 7719 of 2009\n                ------------------------------------\n             Dated this the 6th day of January, 2010\n\n                            O R D E R\n<\/pre>\n<p>    The petitioner had filed Bail Application No.7117\/2009, which<\/p>\n<p>was disposed of by the order dated 08.12.2009. For the sake of<\/p>\n<p>convenience the order dated 08.12.2009 is extracted below:<\/p>\n<blockquote><p>            &#8220;This is an application for bail under Section<\/p>\n<p>      439 of the Code of Criminal Procedure. The<\/p>\n<p>      petitioner is accused No.3 in S.C. No. 774\/2007 on<\/p>\n<p>      the file of the court of Additional Sessions Judge<\/p>\n<p>      (Fast Track No. II, Adhoc), Thrissur.<\/p>\n<\/blockquote>\n<blockquote><p>            2. The offences alleged against the petitioner<\/p>\n<p>      are under Sections 341, 448, 326 and 307 read<\/p>\n<p>      with Section 34 of the Indian Penal Code.<\/p>\n<\/blockquote>\n<blockquote><p>            3.   The   date    of  occurrence     was   on<\/p>\n<p>      13\/10\/2006. The petitioner was arrested on<\/p>\n<p>      6\/1\/2007. The petitioner was later released on bail<\/p>\n<p>      before committal of the case to the Sessions<\/p>\n<p>      Court. After committal to the Sessions court, the<\/p>\n<p>      petitioner was released on bail on 10\/4\/2008. The<\/p>\n<p>      case was posted before the Sessions Court on<\/p>\n<p>      15\/7\/2008 for examination of the witnesses. The<\/p>\n<p><span class=\"hidden_text\">B.A. No. 7719 of 2009           2<\/span><\/p>\n<p>        petitioner did not appear before the court.<\/p>\n<p>        Therefore, bail was cancelled and non-bailable<\/p>\n<p>        warrant was issued against the petitioner. The<\/p>\n<p>        petitioner was arrested in connection with<\/p>\n<p>        another case and on 1\/10\/2009, his arrest was<\/p>\n<p>        recorded in the present case. The petitioner<\/p>\n<p>        was produced before the court on production<\/p>\n<p>        warrant. The petitioner was remanded to<\/p>\n<p>        judicial custody. The petitioner moved an<\/p>\n<p>        application for bail before the Sessions Court,<\/p>\n<p>        which was dismissed by the order dated<\/p>\n<p>        1\/10\/2009.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>              4.    Now the case stands posted to<\/p>\n<p>        15\/12\/2009 for examination of the witnesses.<\/p>\n<p>        The court below held that the petitioner is in<\/p>\n<p>        the habit of making himself scarce when the<\/p>\n<p>        case is posted for trial. The court below has<\/p>\n<p>        also stated in the order that 29 witnesses were<\/p>\n<p>        summoned and their examination could not be<\/p>\n<p>        conducted because of the absence of the<\/p>\n<p>        petitioner before the court. The petitioner was<\/p>\n<p>        absconding. It is alleged that the petitioner is<\/p>\n<p>        involved in other cases as well. The petitioner<\/p>\n<p>        got himself involved in other cases during this<\/p>\n<p><span class=\"hidden_text\">B.A. No. 7719 of 2009            3<\/span><\/p>\n<p>        period. These facts would indicate that the<\/p>\n<p>        petitioner cannot be released on bail at the<\/p>\n<p>        stage when the examination of the witnesses is<\/p>\n<p>        to take place on 15\/12\/2009. The court was<\/p>\n<p>        fully justified in rejecting the application for<\/p>\n<p>        bail. I am also of the view that the petitioner is<\/p>\n<p>        not entitled to get bail in the facts and<\/p>\n<p>        circumstances mentioned above.\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<blockquote><p>              The    Bail  Application   is  accordingly<\/p>\n<p>        dismissed.&#8221;<\/p><\/blockquote>\n<p>      2. It is submitted that the case is now scheduled for trial<\/p>\n<p>before the Sessions Court from 28.05.2010 to 02.06.2010. The<\/p>\n<p>learned counsel submits that in view of the change of<\/p>\n<p>circumstance, the petitioner may be released on bail on<\/p>\n<p>stringent conditions.\n<\/p>\n<p>      3. Taking into account the facts and circumstances of the<\/p>\n<p>case, I am of the view that the petitioner should be permitted to<\/p>\n<p>move an application for bail before the Sessions Court. The<\/p>\n<p>Sessions Court would be in a better position to take note of the<\/p>\n<p>subsequent events and deal with the case more effectively.<\/p>\n<p><span class=\"hidden_text\">B.A. No. 7719 of 2009            4<\/span><\/p>\n<p>      Reserving the right of the petitioner to move the learned<\/p>\n<p>Sessions Judge, this Bail application is closed. If an application<\/p>\n<p>for bail is filed, it shall be disposed of in accordance with law<\/p>\n<p>and nothing mentioned above shall be treated as observations<\/p>\n<p>in favour of or against the petitioner.\n<\/p>\n<\/p>\n<p>                                   K.T.
