The title of the applications state that the<br \/>\napplications are for ?Sreview?? [of the judgment in the respective<br \/>\nFirst Appeals stated above].  However, the prayer made in the<br \/>\napplications is for ?Srecall?? of the judgments.  &#8216;Review&#8217; and<br \/>\n&#8216;recall&#8217; are distinct in legal parlance.  That apart, the affidavit<br \/>\nin support of the applications is not sworn by the respective<br \/>\npetitioners but it is sworn by learned advocate Mr. Balram D. Jain.<br \/>\nOne therefore fails to understand whether the applications are filed<br \/>\nat the instruction of the applicants or at all. Yet, though the<br \/>\napplications deserve dismissal on these technicalities, this court<br \/>\nproposes to dispose of these applications on merits.\n<\/p>\n<p>\tThe learned<br \/>\nCommissioner while passing the award in the respective Workman<br \/>\nCompensation cases has specifically held that the Insurance Company<br \/>\nalone is liable to pay the entire award, including interest and<br \/>\npenalty.  The Insurance Company has, therefore, filed the present<br \/>\nappeals challenging the award whereby it is directed to pay interest<br \/>\nand penalty.\n<\/p>\n<p>\tIf the present<br \/>\napplicants were aggrieved by the award holding only the Insurance<br \/>\nCompany liable for the entire award, interest and penalty, they ought<br \/>\nto have preferred either an appeal or a cross-objection for holding<br \/>\nthe employer also liable jointly and severally.   Having not done so,<br \/>\nthe present applicants cannot pray for any relief in the appeals<br \/>\nfiled by the Insurance Company. The applications, therefore, deserve<br \/>\nto be rejected.\n<\/p>\n<p>\tThat apart, this<br \/>\nCourt was aware and conscious of this fact even while disposing of<br \/>\nthe aforesaid appeals, inasmuch as this Court, placing reliance on<br \/>\nthe judgment rendered by the Apex Court in the case of NEW INDIA<br \/>\nASSURANCE CO. LTD. Vs.  HARSHADBHAI AMRUTBHAI MODHIYA reported in<br \/>\n2006 ACJ 1699 has observed that ?Sthough the learned Commissioner<br \/>\nhas passed the award only against the Insurance Company and has not<br \/>\npassed any award against the respondents No.2 and 3 herein and the<br \/>\nsame is not challenged by the claimants, considering the fact that<br \/>\nthe Act is a social welfare legislation, it is held that the employer<br \/>\nshall be liable to pay the amount of interest to the claimants??.<br \/>\nThus, having carefully considered the fact that the claimants have<br \/>\nnot challenged the award, yet taking a humanitarian view in the light<br \/>\nof the fact that the Act is a social welfare legislation, this Court<br \/>\ndirected that the employer shall be liable to pay the amount of<br \/>\ninterest to the claimants.
