PP for\nRespondent(s) :\n1, \n======================================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/10\/2011\n \n\nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\n\tpresent Revision Application has been filed by the applicant under<br \/>\n\tSections 401, 397, 216, 319 and 482 of the Criminal Procedure Code,<br \/>\n\t1973 for the prayer that the order passed by the Learned Additional<br \/>\n\tSessions Judge, Court No.10, Ahmedabad below application, Exh.69 in<br \/>\n\tSessions Case No.35 of 2009 dated 30.08.2011 may be quashed and set<br \/>\n\taside and the proceedings of Sessions Case No.35 of 2009 may be<br \/>\n\tstayed on the grounds stated in the application.\n<\/p>\n<p>\tHeard<br \/>\n\tlearned counsel, Mr.Rajesh K. Shah for the applicant and learned<br \/>\n\tSpecial Pupblic Prosectuor Mr.J.M. Panchal for the respondent-State.\n<\/p>\n<p>\tLearned<br \/>\n\tcounsel, Mr.Shah has referred to the papers and submitted that it is<br \/>\n\tevident that the incident is of February, 2002 and the charge was<br \/>\n\tframed in August, 2010. Learned counsel, Mr.Shah submitted that the<br \/>\n\twitnesses have stated about the involvement of the persons, who are<br \/>\n\tsought to be arraigned as accused and considering the stage of the<br \/>\n\ttrial that it was pending for recording the further statement under<br \/>\n\tSection 313 of the Criminal Procedure Code, the application was<br \/>\n\trejected. Learned counsel, Mr.Shah has submitted that it has to be<br \/>\n\tappreciated that the say of few witnesses suggests the involvement<br \/>\n\tof some persons, who are to be arraigned as accused. He submitted<br \/>\n\tthat therefore the discretion could be exercised in the interest of<br \/>\n\tjustice at any stage and the application could not have been<br \/>\n\trejected. He submitted that at-least further investigation could<br \/>\n\thave been ordered. He, therefore, submitted that the present<br \/>\n\tapplication may be allowed.\n<\/p>\n<p>\tLearned<br \/>\n\tSpecial PP Mr.Panchal, however, resisted the present Revision<br \/>\n\tApplication. He pointedly referred to the provisions of Section 319<br \/>\n\tof the Criminal Procedure Code and submitted that the statements of<br \/>\n\tthe witnesses recorded under Section 161 of the Criminal Procedure<br \/>\n\tCode during investigation are not a substantive piece of evidence<br \/>\n\tand the Investigating Agency has to produce material and evidence<br \/>\n\tcollected during the course of investigation to arraign somebody as<br \/>\n\taccused. He, therefore, submitted that such powers has to be<br \/>\n\texercised sparingly as there are compelling reasons to do so. He<br \/>\n\tsubmitted that before exercising such direction under Section 319 of<br \/>\n\tthe Criminal Procedure Code, the Court has to consider the evidence<br \/>\n\ton record. He, therefore, submitted that the present application may<br \/>\n\tnot be entertained.\n<\/p>\n<p>\tHaving<br \/>\n\theard learned counsel appearing for the respective parties and in<br \/>\n\tview of the submissions, it is required to be considered whether the<br \/>\n\timpugned order calls for any interference in exercise of revisional<br \/>\n\tjurisdiction or not.\n<\/p>\n<p>\tIt<br \/>\n\tis well accepted that the scope of revision is limited and the<br \/>\n\tprovision of Section 319 of the Criminal Procedure Code is enabling<br \/>\n\tthe provisions but the Court has to be careful to exercise such<br \/>\n\tpowers sparingly and not casually. Therefore, before a person could<br \/>\n\tbe arraigned as accused during the trial, there has to be a<br \/>\n\tmaterial, which could be examined in a given case. However, merely<br \/>\n\tbecause an application is made, one cannot be arraigned as accused<br \/>\n\tso easily without any supporting material. It is in these<br \/>\n\tcircumstances, without any reason or justification much less any<br \/>\n\tcompelling reason, there is no need to exercise the discretion under<br \/>\n\tSection 319 of the Criminal Procedure Code read with Sections 397<br \/>\n\tand 401 of the Criminal Procedure Code. It is well accepted that<br \/>\n\tthere is no lack of jurisdiction or power but it is a matter with<br \/>\n\tregard to exercise of such power with caution and on scrutiny of<br \/>\n\tmaterial and justification for exercise of such powers.\n<\/p>\n<p>\tIt<br \/>\n\tis required to be mentioned that the person cannot easily be joined<br \/>\n\tas accused on the basis of the progress in the trial when some<br \/>\n\twitnesses have stated something without any further material and<br \/>\n\tevidence. If that is accepted, it would lead to a chaos whether<br \/>\n\tduring trial, person can make addition of the accused persons<br \/>\n\twithout any reason or justification.\n<\/p>\n<p>\tIn<br \/>\n\tthe facts of the present case, as there is no such circumstances or<br \/>\n\tcompelling reasons has been pointed out, there is no need to<br \/>\n\tinterfere with the order passed by the Sessions Court.\n<\/p>\n<p>\tHence,<br \/>\n\tthe present Revision Application deserves to be dismissed and<br \/>\n\taccordingly stands dismissed.\n<\/p>\n<p>(RAJESH<br \/>\nH.SHUKLA, J.)<\/p>\n<p>\/patil<\/p>\n<p>FURTHER<br \/>\nORDER<\/p>\n<p>\tAfter<br \/>\nthe order was pronounced, learned counsel, Mr.R.K. Shah has requested<br \/>\nfor the stay of operation of the order, which is strongly objected by<br \/>\nthe leaned counsel, Mr.Panchal stating that no stay has been<br \/>\noperating in the trial and, therefore, same may not be stayed.\n<\/p>\n<p>\tIn<br \/>\nthe circumstances, the operation of the order is stayed to enable the<br \/>\napplicant to have his recourse before the Hon&#8217;ble Apex Court till<br \/>\n11th November, 2011.
