PUBLIC PROSECUTOR for Respondent(s) : 1, \nMRKJPANCHAL for\nComplainant  \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/09\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe present<br \/>\napplication has been filed by the applicant for grant of regular bail<br \/>\nunder sec. 439 of the Code of Criminal Procedure.\n<\/p>\n<p>2.\tThe applicant-accused<br \/>\nis charged with having committed offences under sections 406, 409,<br \/>\n420, 465, 467, 468, 471, 477A, 120B of IPC and sec. 46 of the Banking<br \/>\nRegulation Act for which FIR, being C.R. No. I-10\/2010, has been<br \/>\nregistered with Gandhinagar Zone Police Station (Economic Cell).\n<\/p>\n<p>3.\tLearned advocate Mr.<br \/>\nAnil Dave has shown willingness to make the payment and has tendered<br \/>\na pay order\/draft of Rs. 50,00,000\/- to learned advocate Mr. Panchal,<br \/>\nwhich is accepted by him on instruction without prejudice to the<br \/>\nrights and contentions.   Learned counsel Mr. Dave has also agreed to<br \/>\nmake further payment in installments and has stated that he files an<br \/>\nundertaking of the petitioner for the schedule of payment which he<br \/>\nwould abide by.\n<\/p>\n<p>4.\tLearned advocate Mr.<br \/>\nPanchal has stated that this is without prejudice to the rights and<br \/>\ncontentions and if any of the conditions stated in the undertaking<br \/>\nincluding default in making payment of the installments as stated in<br \/>\nthe undertaking, it may be permitted to be treated as a ground for<br \/>\ncancellation of the bail.\n<\/p>\n<p>5.\tTherefore,<br \/>\nconsidering the gesture made by the applicant along with the<br \/>\nundertaking filed today stating about the schedule of payment of<br \/>\ninstallments, the present application deserves to be allowed.\n<\/p>\n<p>6.\tIt<br \/>\nis clarified that if there is any default in payment of any of the<br \/>\ninstallments as stated in the undertaking of schedule, it would be<br \/>\nopen for the bank to initiate appropriate proceedings including an<br \/>\napplication for cancellation of the bail.\n<\/p>\n<p>7.\tThe application is<br \/>\naccordingly allowed.  The applicant is ordered to be released on bail<br \/>\nin connection with C.R. No. I-10\/2010 registered with  Gandhinagar<br \/>\nZone Police Station (Economic Cell)  on his executing a personal bond<br \/>\nof Rs. 5,000\/- (Rupees Five Thousand only) with one solvent surety<br \/>\nfor the like amount to the satisfaction of the lower court and<br \/>\nsubject to the further conditions that he shall :\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to try to tamper<br \/>\nor pressurize the prosecution witnesses or complainant in any manner;\n<\/p>\n<p>(c )\tnot act in any<br \/>\nmanner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain law and<br \/>\norder and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark his presence<br \/>\nbefore the concerned Police Station on the first Monday of every<br \/>\ncalendar month between 11.00 am to 2.00 pm till the charge sheet is<br \/>\nfiled.\n<\/p>\n<p>(f)\tfurnish the address<br \/>\nof his residence to the investigating officer and also to the court<br \/>\nat the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender his<br \/>\npassport, if any, to the lower court, within a week.\n<\/p>\n<p>7.\tIf breach of any of<br \/>\nthe above conditions is committed, the concerned Sessions Judge will<br \/>\nbe free to issue warrant or take appropriate action in the matter.\n<\/p>\n<p>8.\tBail before the lower<br \/>\ncourt having jurisdiction to try the case.
