Justice V.RAMKUMAR\n\n Dated :10\/03\/2010\n\n O R D E R\n                = = = = =V.RAMKUMAR,=2010 = =\n                                           J.\n                           = = = = = =       = ==\n\n              Dated, this the 10th day of=March, 2010\n                = = =Crl.R.P. = = =871=of = = = = =\n                      = = =No.        =\n\n\n                              O R D E R\n<\/pre>\n<p>      In this Revision    Petition filed under Section 397 read with<br \/>\nSec. 401 Cr.P.C. the petitioner who was the accused in C.C. NO.<br \/>\n191 of 2007 on the file of the J.F.C.M. III, Kottarakkara, challenges<br \/>\nthe conviction entered and the sentence passed against him for an<br \/>\noffence punishable under Sec. 138 of the Negotiable Instruments<br \/>\nAct, 1881 (hereinafter referred to as &#8216;the Act&#8217;).      The    cheque<br \/>\namount was Rs. 2,00,000\/-.        The compensation ordered by the<br \/>\nlower appellate court is Rs. 2,00,000\/-.\n<\/p>\n<p>      2.    I heard the learned counsel for the Revision Petitioner<br \/>\nand the learned Public Prosecutor.\n<\/p>\n<p>      3.    The learned counsel appearing for the Revision Petitioner<br \/>\nre-iterated the contentions in support of the Revision.\n<\/p>\n<p>      4.     The courts below have concurrently held that the cheque<br \/>\nin question was drawn by the petitioner            in favour of the<br \/>\ncomplainant, that the complainant had validly complied with clauses\n<\/p>\n<p>(a) and (b) of the proviso to Section 138 of the Act.    and that the<br \/>\nRevision Petitioner\/accused failed to make the payment within 15<br \/>\ndays of receipt of the statutory notice.        Both the courts have<br \/>\nconsidered and rejected the defence set up by the revision<br \/>\npetitioner while entering the conviction.    The said conviction has<br \/>\nbeen recorded      after a careful evaluation       of the oral and<\/p>\n<p><span class=\"hidden_text\">Crl.R.P. No.   871 of 2010        -:2:-<\/span><\/p>\n<p>documentary evidence. This Court sitting in the rarefied revisional<br \/>\njurisdiction will be loath to interfere with the findings of fact<br \/>\nrecorded by the courts below concurrently. I do not find any error,<br \/>\nillegality or impropriety in the conviction so recorded concurrently<br \/>\nby the courts below and the same is hereby confirmed.\n<\/p>\n<p>      5.       What now survives for consideration is the legality of<br \/>\nthe sentence imposed on the revision petitioner.       In the light of<br \/>\nthe decision of the Supreme Court in Ettappadan Ahammedkutty<br \/>\nv. E.P. Abdullakoya &#8211; 2008 (1) KLT 851 default sentence cannot be<br \/>\nimposed for the enforcement of an order for compensation under<br \/>\nSec. 357 (3) Cr.P.C.        I am, therefore, inclined to modify the<br \/>\nsentence to one of fine only. Accordingly, for the conviction under<br \/>\nSection 138 of the Act the revision petitioner is sentenced to pay a<br \/>\nfine of Rs. 2,05,000\/-        (Rupees two lakh five thousand only).<br \/>\nThe said fine shall be paid as compensation under Section 357 (1)<br \/>\nCr.P.C.    The revision petitioner is permitted either to deposit the<br \/>\nsaid fine amount before the Court below         or directly pay the<br \/>\ncompensation to the complainant within six months from today and<br \/>\nproduce a memo to that effect before the trial Court in case of<br \/>\ndirect payment. If he fails to deposit or pay the said amount within<br \/>\nthe aforementioned period he shall suffer simple imprisonment for<br \/>\nthree months by way of default sentence.\n<\/p>\n<p>      In the result, this Revision is disposed of confirming the<br \/>\nconviction entered but modifying the sentence imposed on the<br \/>\nrevision petitioner.\n<\/p>\n<p>      Dated this the 10th day of March, 2010.\n<\/p>\n<p>                                         Sd\/- V.
