4.   05.07.2011            Heard learned counsel for the petitioners and the<\/p>\n
                  State.\n<\/p>\n
                           The petitioners are stated to be employees of the
\n                         2<\/span><\/p>\n
Co-operative Department aggrieved by non consideration of<\/p>\n
their   cases     for       deputation          as   Block     Development<\/p>\n
Officer\/Circle     Officer         by     the    Department        of   Rural<\/p>\n
Development.\n<\/p>\n
          Counsel for the parties are not at issue that in so<\/p>\n
far as petitioner nos. 1, 4, 5 and 6 are concerned, rejection<\/p>\n
of their candidature for departmental lapses in not<\/p>\n
furnishing      their       A.C.R.      reports      or    other   necessary<\/p>\n
information cannot visit them with adverse consequences if<\/p>\n
they were otherwise eligible for consideration under the<\/p>\n
advertisement. Any non consideration on that ground only<\/p>\n
is arbitrary.    Subject to availability of vacancies and the<\/p>\n
need for personnel, the said petitioners do have a right to<\/p>\n
be considered especially if their juniors have been selected<\/p>\n
ignoring their claims for no valid reason when the<\/p>\n
respondents       may         be        required      to     make       proper<\/p>\n
rearrangement of appointments so that Article 14 does not<\/p>\n
stand violated.\n<\/p>\n
          In so far as petitioner no. 2 is concerned, in view<\/p>\n
of the fact that departmental proceedings were pending<\/p>\n
against him as on the date of consideration and still remain<\/p>\n
pending, the Court finds no error in the action of the<\/p>\n
respondents declining his consideration.<\/p>\n
          On      the       date     of   consideration       departmental<\/p>\n
proceedings were also pending against petitioner no. 3.
\n                                     3<\/span><\/p>\n
           There can thus be no illegality in the action of the<\/p>\n
           respondents in not considering him as on the relevant date.<\/p>\n
           But if, as was submitted on behalf of the petitioner, he has<\/p>\n
           been   subsequently            exonerated    in     the     departmental<\/p>\n
           proceeding on 9.10.2010, and vacancy subsists, the<\/p>\n
           petitioner     fulfils       other   conditions    of     eligibility,   the<\/p>\n
           respondents require more personnel for deputation, his<\/p>\n
           case may be considered.\n<\/p>\n
                        The order to be complied with within a maximum<\/p>\n
           period of two months from the date of receipt\/production of<\/p>\n
           a copy of this order.\n<\/p>\n
                        The writ application stands disposed.<\/p>\n
