Misc. No.31402 of 2011\n                       Bade Sharma son of Sri Jai Kishore Sharma\n                                        Versus\n                                  The State Of Bihar\n                                       -----------\n<\/pre>\n<p>2\/   22.09.2011                    Heard learned counsel for the petitioner and the State.<\/p>\n<p>                                   The petitioner seeks bail in a case instituted for the<\/p>\n<p>                       offence under sections 302, 120-B of the Indian Penal Code and<\/p>\n<p>                       section 27 of the Arms Act.\n<\/p>\n<p>                                   Considering that apart from suspicion and confessional<\/p>\n<p>                       statement of the co-accused there is no material against the<\/p>\n<p>                       petitioner, let the petitioner, above named, be released on bail on<\/p>\n<p>                       furnishing bail bond of Rs.5,000\/- (five thousand) with two sureties<\/p>\n<p>                       of the like amount each or any other surety to be fixed by the court<\/p>\n<p>                       below to the satisfaction of the Additional Chief Judicial Magistrate,<\/p>\n<p>                       Patna City, Patna, in connection with Malsalami P.S. Case No.93 of<\/p>\n<p>                       2011, subject to the conditions (i) That one of the bailors will be a<\/p>\n<p>                       close relative of the petitioner, who will give an affidavit giving<\/p>\n<p>                       genealogy as to how he is related with the petitioner and another<\/p>\n<p>                       bailor shall be the father\/mother of the petitioner. The bailors will<\/p>\n<p>                       undertake to furnish information to the court about any change in the<\/p>\n<p>                       address of the petitioner, (ii) That the bailors shall also state on<\/p>\n<p>                       affidavit that they will inform the court concerned if the petitioner is<\/p>\n<p>                       implicated in any other case of similar nature after his release in the<\/p>\n<p>                       present case and thereafter the court below will be at liberty to<\/p>\n<p>                       initiate the proceeding for cancellation of bail on the ground of<\/p>\n<p>                       misuse, (iii) That the petitioner will give an undertaking that he will<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>       receive the police papers on the given date and be present on date<\/p>\n<p>       fixed for charge and if he fails to do so on two given dates and<\/p>\n<p>       delays the trial in any manner, his bail will be liable to be cancelled<\/p>\n<p>       for reasons of misuse, and (iv) That the petitioner will be well<\/p>\n<p>       represented on each date and if he fails to do so on two consecutive<\/p>\n<p>       dates, his bail will be liable to be cancelled.\n<\/p>\n<p>                   In view of the antecedents of the petitioner, the<\/p>\n<p>       petitioner is directed to appear before the Sr. Superintendent of<\/p>\n<p>       Police, Patna, within fifteen days of his release with a copy of this<\/p>\n<p>       order and every two weeks thereafter for the next nine months. The<\/p>\n<p>       conduct of the petitioner will be kept under watch in this period by<\/p>\n<p>       the Superintendent of Police concerned and if it is found wanting in<\/p>\n<p>       any respect, a report shall be made to the court concerned by him to<\/p>\n<p>       initiate a proceeding for cancellation of bail for reasons of misuse of<\/p>\n<p>       bail.
