Munsi, learned counsel for<br \/>\nthe petitioner and Mr. Toliya, learned counsel for respondent No.2.\n<\/p>\n<p>2.\tPrima<br \/>\nfacie it appears that the Charity Commissioner has exceeded in his<br \/>\njurisdiction for inducting the respondent No.1 as trustee titling him<br \/>\nas Patshishya of the original President, though there was no material<br \/>\nto be considered by proved record that during the life time of the<br \/>\nShri Jitendrasuriswarji Maharaj Saheb and Acharya Labdhichandra<br \/>\nSuriswarji Maharaj Saheb the respondent No.2 was appointed as<br \/>\nPatshishya.\n<\/p>\n<p>3.\tThe<br \/>\ncontention on behalf of the respondent No.2 by Mr. Toliya, learned<br \/>\ncounsel is that the Charity Commissioner has found that there are<br \/>\nillegalities committed in functioning and the reputation of some<br \/>\ncertain trustees is at cloud and therefore, for better<br \/>\nadministration, the instructions have been issued.\n<\/p>\n<p>4.\tIn<br \/>\nmy view, if the authority of respondent No.2, who preferred original<br \/>\napplication before the Charity Commissioner is lacking, he could not<br \/>\nhave been inducted, but in his place, the Joint Charity Commissioner,<br \/>\neither himself or his any of the officer, who may be appointed by<br \/>\nhim, can be substituted to associate with the administration of the<br \/>\ntrust and further if any breach of the instruction is found or there<br \/>\nis misapplication of the funds or any illegalities, further action<br \/>\ncan also be taken.\n<\/p>\n<p>5.\tHence,<br \/>\nNOTICE returnable on 20.10.2008. By interim order, it<br \/>\nis directed that that order of the Charity Commissioner for so far as<br \/>\nit relates to issuing the instruction dated 17.9.2008, shall continue<br \/>\nto remain in operation but with modification with in place of<br \/>\noriginal applicant No.1, Joint Charity Commissioner himself or<br \/>\nofficer, who may be nominated by him, not below the rank of Assistant<br \/>\nCharity Commissioner shall get substituted. The matter shall be<br \/>\nconsidered for final disposal on the next returnable date.
