The petitioner has further prayed for the direction to the<br \/>\n\tAppellate Authority to entertain the Appeal of the petitioner under<br \/>\n\tSection-127 of the Electricity Act, 2003 against the final order of<br \/>\n\tassessment dated 20.2.2009 by condoning the delay so that the<br \/>\n\tpetitioner can raise all his contentions before the said authority.\n<\/p>\n<p>\tThis Court has issued<br \/>\n\trule on 13.1.2010. Rule was duly served on the respondents.<br \/>\n\tMs.Manisha Narsinghani, learned Assistant Government Pleader appears<br \/>\n\ton behalf of the respondent No.1 and Mr. S. N.Sinha, learned<br \/>\n\tadvocate appears on behalf of the respondent No.2.\n<\/p>\n<p>\tSince the petitioner has<br \/>\n\talready filed an Appeal against the final assessment order, the<br \/>\n\tCourt is not inclined to consider and grant main prayer of the<br \/>\n\tpetitioner for quashing and setting aside the said final assessment<br \/>\n\torder. However, the Appellate Authority without going into merits of<br \/>\n\tthe matter has dismissed the Appeal filed by the petitioner only on<br \/>\n\tthe ground of limitation. The alternative prayer made by the<br \/>\n\tpetitioner is, therefore, required to be considered and examined by<br \/>\n\tthe Court.\n<\/p>\n<p>\tThe<br \/>\n\tfinal assessment order is passed on 20.2.2009 under Section-126 of<br \/>\n\tthe Electricity Act, 2003. An Appeal is provided against this order<br \/>\n\tunder Section-127 of the Act. Sub-section 1 of Section-127 empowers<br \/>\n\tthe aggrieved party to file an Appeal within 30 days from the date<br \/>\n\tof receipt of the assessment order. The petitioner was, therefore,<br \/>\n\tsupposed to file Appeal before the Appellate<br \/>\n\tAuthority within 30 days from the date of receipt of the order. The<br \/>\n\tpetitioner could not file the said Appeal within the prescribed time<br \/>\n\tlimit. The Appeal was filed only on 23.3.2009.\n<\/p>\n<p>\tSince the petitioner&#8217;s<br \/>\n\tAppeal could not be accepted by Navsari and Valsad Office, the<br \/>\n\tpetitioner wrote a letter to the Appellate Authority on 14.9.2009<br \/>\n\trequesting to issue direction to accept the petitioner&#8217;s Appeal. The<br \/>\n\tAppellate Authority vide its letter dated 15.9.2009 has informed the<br \/>\n\tpetitioner that since the Appeal was filed beyond the period of 30<br \/>\n\tdays the said Appeal could not be accepted.\n<\/p>\n<p>\tIt<br \/>\n\tis true that the petitioner has not explained any reason as to why<br \/>\n\tthe delay was caused in filing an Appeal before the Appellate<br \/>\n\tAuthority. However, this fact was not put by the Appellate Authority<br \/>\n\tto the petitioner and no<br \/>\n\texplanation is sought for with regard to late filing of an Appeal.<br \/>\n\tAs a matter of fact, the Appellate Authority has simply observed in<br \/>\n\tthe order that the Appeal was not filed within the period of 30 days<br \/>\n\tfrom the date of the final order and hence the said Appeal could not<br \/>\n\tbe accepted. The order passed by the Appellate Authority is,<br \/>\n\ttherefore, in violation of the principle of natural justice and<br \/>\n\twithout affording any opportunity of being heard to the petitioner.\n<\/p>\n<p>\tIn the above view of the<br \/>\n\tmatter, the impugned order passed by the Appellate Authority on<br \/>\n\t15.9.2009 is hereby quashed and set aside and the matter is remanded<br \/>\n\tto the Appellate Authority with a direction to call for the<br \/>\n\texplanation from the petitioner with regard to condonation of delay<br \/>\n\tand if there is any substance in the explanation the same may be<br \/>\n\tcondoned and the Appeal may be decided on its own merits.\n<\/p>\n<p>\tThe<br \/>\n\tCourt has taken the above view considering the decision of this<br \/>\n\tCourt in the case of  Mahesh<br \/>\n\tHarilal Khamar Vs. B.N. Naransimhan &amp; Anr., 23(2) GLR 124<br \/>\n\tas well as another decision of this Court in the case of  Gujarat<br \/>\n\tElectricity Board Vs. Savjibhai Hansrajbhai @ Harjihai, decided on<br \/>\n\t17.10.2005 in Special Civil Application No.14566 of 2005,<br \/>\n\twherein also delay in question was of 87 days and after condoning<br \/>\n\tthe delay the Court has directed the authority to decide the matter<br \/>\n\ton merits.\n<\/p>\n<p>\t In the above view of the<br \/>\n\tmatter, the petition is allowed to the above extent.
