CHINNAPPA (J)\nMISRA RANGNATH\n\nCITATION:\n 1984 AIR 1571\t\t  1985 SCR  (1) 199\n 1984 SCC  (4) 235\t  1984 SCALE  (2)61\n\n\nACT:\n     Supreme  Court  Rules  1966-Order\tXXXVI-A-Inserted  by\nG.S.R. 1024  dated 19-8-1978-Application  for transfer under\nClause (1)  of Article 139A of the Constitution-Requirements\nof valid petition.\n     Practice-Drafting and  filing petition  in\t casual\t and\ncareless manner-Whether proper discharge of duty by advocate\nto court and client.\n\n\n\nHEADNOTE:\n     A petition\t for withdrawing  a writ petition pending in\nthe High  Court to  the Supreme Court under Article 139A (1)\nof the\tConstitution mentioned\tnothing else except that the\nwrit petition  pending in  the High Court raised exactly the\nsame questions\tas those  raised in a special leave petition\npending in  the Supreme\t Court. What  the questions were and\nwhat the facts of the cases were was not disclosed.\n     Dismissing the petition,\n^\n     HELD: It  is most discourteous and disrespectful to the\nhighest court  in  the\tcountry\t to  file  such\t indifferent\npetitions. The\tadvocate; is not discharging his duty either\nto the court or to the client. Sharma for the Respondent.\n<\/p>\n<p>     The Order of the court was delivered by<br \/>\n<span class=\"hidden_text\">200<\/span><br \/>\n     CHINNAPPA REDDY,  J. This petition is totally bereft of<br \/>\nany statement  of facts.  It has been drafted and filed in a<br \/>\nmost casual  and careless  manner. All that is stated in the<br \/>\npetition is  that the Writ Petition pending in the Rajasthan<br \/>\nHigh Court raises exactly the same questions as those raised<br \/>\nin SLP\t(Civil) No.  7561\/83 pending  in this  Court and the<br \/>\nwrit petition  may, therefore, be transferred to this Court.<br \/>\nNothing else  is mentioned. No facts relating to either case<br \/>\nare mentioned.\tEven the  alleged common  questions are\t not<br \/>\nstated. We  can only  say that\tit is  most discourteous and<br \/>\ndisrespectful to  the highest  court in\t the country to file<br \/>\nsuch indifferent  petitions.
