No.34458 of 2008\n           ------------------------------------------------\n          Dated this the 21st day of November, 2008\n\n                         JUDGMENT\n<\/pre>\n<p>    Petitioners are the defendants in O.S.759\/07<\/p>\n<p>on the file of the II Additional Sub Court,<\/p>\n<p>Thiruvananthapuram and the respondents are the<\/p>\n<p>plaintiffs  therein.          The      prayer         in   this   Writ<\/p>\n<p>Petition is to direct the II Additional Sub Judge,<\/p>\n<p>Thiruvananthapuram       to      consider          and     dispose of<\/p>\n<p>I.A.5769\/07 in O.S.759\/07 filed by the respondents<\/p>\n<p>on  merits   taking         into        account          also   Ext.P5<\/p>\n<p>objections  filed      by      them       as     expeditiously      as<\/p>\n<p>possible and within a time limit to be fixed by<\/p>\n<p>this Court.\n<\/p>\n<p>    2. Considering the nature of the order that I<\/p>\n<p>propose to pass in this Writ Petition, I dispense<\/p>\n<p>with notice to the respondents.\n<\/p>\n<p>    3. Ext.P1 is the plaint in the suit. The said<\/p>\n<p>suit is one for a decree for mandatory injunction<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.34458 of 2008            -2-<\/span><\/p>\n<p>      directing the petitioners\/defendants to restore<\/p>\n<p>      lateral support to &#8216;A&#8217; Schedule property that was<\/p>\n<p>      available from &#8216;B&#8217; schedule property and which was<\/p>\n<p>      destroyed by them at the cost of the defendants<\/p>\n<p>      themselves         and  for   a   prohibitory  injunction<\/p>\n<p>      restraining         them  from  alienating  &#8216;B&#8217;  schedule<\/p>\n<p>      property. On the application of the respondents,<\/p>\n<p>      the trial court issued Ext.P3 order of interim<\/p>\n<p>      prohibitory         injunction   on  Ext.P2   application<\/p>\n<p>      restraining         the  counter   petitioners  who   are<\/p>\n<p>      petitioners         herein   from   alienating  the   &#8216;B&#8217;<\/p>\n<p>      schedule          property   to   anyone   else  without<\/p>\n<p>      reconstructing the eastern compound wall of plaint<\/p>\n<p>      &#8216;A&#8217; schedule property and restoring the lateral<\/p>\n<p>      support. The petitioners filed Ext.P5 objection to<\/p>\n<p>      the said injunction petition. The grievance of the<\/p>\n<p>      petitioners that is highlighted before me by the<\/p>\n<p>      counsel         for  the   petitioners  is   that  though<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.34458 of 2008           -3-<\/span><\/p>\n<p>      objection was filed on 15\/02\/08 to I.A.5769\/07<\/p>\n<p>      when     it     stood  posted  for  objections, it  was<\/p>\n<p>      adjourned         for hearing  to  27\/06\/08  after  four<\/p>\n<p>      months and from that date it was adjourned to<\/p>\n<p>      10\/10\/08         and  thereafter  to  23\/01\/09   without<\/p>\n<p>      vacating         the  ex  parte  interim injunction   or<\/p>\n<p>      passing considered final orders thereon.<\/p>\n<p>              4.     It   is  submitted that  Ext.P6  written<\/p>\n<p>      statement was also filed on 15\/11\/08 though it had<\/p>\n<p>      not been filed on 27\/06\/08 as represented or on<\/p>\n<p>      10\/10\/08, the adjourned date, but with a petition<\/p>\n<p>      to receive the same. However, what the petitioner<\/p>\n<p>      wants is to expedite disposal of the injunction<\/p>\n<p>      petition and to have orders passed thereon on<\/p>\n<p>      merits.\n<\/p>\n<p>              5. In the result, I direct the court below to<\/p>\n<p>      consider         the  injunction application  filed   in<\/p>\n<p>      O.S.759\/07 advancing its hearing on a motion made<\/p>\n<p><span class=\"hidden_text\">W. P. C. No.34458 of 2008          -4-<\/span><\/p>\n<p>      by the petitioners\/defendants in that behalf and<\/p>\n<p>      to     pass     appropriate orders thereon  on   merits<\/p>\n<p>      before        closing  of  the  courts  for   Christmas<\/p>\n<p>      holidays. The petitioner is directed to produce a<\/p>\n<p>      copy of this judgment along with the advance<\/p>\n<p>      petition that he is to file in the court below<\/p>\n<p>      with      notice    to  counsel for  the   respondents\/<\/p>\n<p>      plaintiffs to enable the court to take appropriate<\/p>\n<p>      action as directed above.\n<\/p>\n<p>              6.
