The \u00a0 applicant \u00a0 submitted \u00a0 identical \u00a0 RTI\u00a0<br \/>\napplications \u00a0 dated \u00a0 5 \u00a0 March \u00a0 2010 \u00a0 before \u00a0 the \u00a0 CPIO,\u00a0<br \/>\nCBSE, \u00a0 New \u00a0 Delhi \u00a0 and \u00a0 CPIO, \u00a0 CBSE, \u00a0 Ajmer \u00a0 seeking\u00a0<br \/>\ninformation\u00a0pertaining\u00a0to\u00a0the\u00a0date\u00a0of\u00a0birth\u00a0of\u00a0Shri\u00a0N\u00a0<br \/>\nRajen \u00a0 Singh \u00a0 who \u00a0 had \u00a0 passed \u00a0 the \u00a0 All \u00a0 India \u00a0 Higher\u00a0<br \/>\nSecondary\u00a0Examination\u00a0in\u00a01970.\n<\/p>\n<p>2.    The\u00a0CPIOs\u00a0denied\u00a0disclosure\u00a0of\u00a0information\u00a0under\u00a0<br \/>\nthe\u00a0provisions\u00a0of\u00a0section\u00a08\u00a0(1)\u00a0(e)\u00a0and\u00a0section\u00a08\u00a0(1)\u00a0\n<\/p>\n<p>(g)\u00a0of\u00a0the\u00a0Act\u00a0respectively.\u00a0The\u00a0applicant\u00a0preferred\u00a0<br \/>\nappeal \u00a0 dated \u00a0 5 \u00a0 March \u00a0 2010 \u00a0 and \u00a0 31 \u00a0 March \u00a0 2010 \u00a0 before\u00a0<br \/>\nthe \u00a0 respective \u00a0 first \u00a0 appellate \u00a0 authorities. \u00a0 The\u00a0<br \/>\nmatter \u00a0 was \u00a0 disposed \u00a0 of \u00a0 vide \u00a0 FAA \u00a0 orders \u00a0 dated \u00a0 5 \u00a0 May\u00a0<br \/>\n2010 \u00a0 and \u00a0 27 \u00a0 April \u00a0 2010 \u00a0 by \u00a0 denying \u00a0 disclosure \u00a0 under\u00a0<br \/>\nthe\u00a0provisions\u00a0of\u00a0section\u00a08\u00a0(1)\u00a0(e)\u00a0and\u00a0section\u00a08\u00a0(1)\u00a0\n<\/p>\n<p>(g)\u00a0of\u00a0the\u00a0Act\u00a0respectively.\n<\/p>\n<p>3.    Being \u00a0 aggrieved \u00a0 and \u00a0 not \u00a0 being \u00a0 satisfied \u00a0 by \u00a0 the\u00a0<br \/>\nabove \u00a0 decisions, \u00a0 the \u00a0 appellant \u00a0 preferred \u00a0 second\u00a0<br \/>\nappeal \u00a0 before \u00a0 the \u00a0 Commission. \u00a0 The \u00a0 matter \u00a0 was \u00a0 heard\u00a0<br \/>\ntoday. \u00a0 Respondent \u00a0 was \u00a0 present \u00a0 as \u00a0 above \u00a0 and \u00a0 heard \u00a0 in\u00a0<br \/>\nperson\u00a0from\u00a0New\u00a0Delhi\u00a0and\u00a0also\u00a0from\u00a0Ajmer.\u00a0Appellant\u00a0<br \/>\nwas \u00a0present \u00a0and \u00a0heard \u00a0through \u00a0videoconferencing \u00a0from\u00a0<br \/>\nImphal.\u00a0Respondent\u00a0stated\u00a0that\u00a0information\u00a0sought\u00a0was\u00a0<br \/>\nover \u00a0 40 \u00a0 years \u00a0 old \u00a0 and \u00a0 that \u00a0 as \u00a0 per \u00a0 the \u00a0 schedule \u00a0 of\u00a0<br \/>\nretention \u00a0 and \u00a0 destruction \u00a0 of \u00a0 records \u00a0 they \u00a0 are\u00a0<br \/>\nrequired \u00a0 to \u00a0 maintain \u00a0 records \u00a0 only \u00a0 for \u00a0 35 \u00a0 years.\u00a0\n<\/p>\n<p>                                       Appeal\u00a0:\u00a0No.\u00a0CIC\/DS\/A\/2010\/001958\u00a0<\/p>\n<p>                                                                        \u00a0<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>Therefore \u00a0 \u00a0 \u00a0 the \u00a0 requested \u00a0 information \u00a0 had \u00a0 been\u00a0<br \/>\ndestroyed \u00a0and \u00a0the\u00a0same \u00a0could \u00a0not\u00a0 be\u00a0provided \u00a0 to\u00a0the\u00a0<br \/>\nappellant. \u00a0 Respondent \u00a0 from \u00a0 Ajmer \u00a0 stated \u00a0 that \u00a0 he \u00a0 had\u00a0<br \/>\nerroneously \u00a0 quoted \u00a0 the \u00a0 wrong \u00a0 section \u00a0 while \u00a0 denying\u00a0<br \/>\ninformation \u00a0 which \u00a0 should \u00a0 have \u00a0 been \u00a0 rightly \u00a0 denied\u00a0<br \/>\nunder\u00a0the\u00a0provisions\u00a0of\u00a0section\u00a08\u00a0(1)\u00a0(j)\u00a0of\u00a0the\u00a0Act\u00a0<br \/>\nand \u00a0 also \u00a0 that \u00a0 the \u00a0 requested \u00a0 information \u00a0 had \u00a0 been\u00a0<br \/>\ndestroyed\u00a0as\u00a0per\u00a0their\u00a0approved\u00a0schedule.\n<\/p>\n<p>                       Decision\u00a0notice<\/p>\n<p>4.
