Advocate\n\nHon'ble Ravindra Singh,J.\n<\/pre>\n<p>Heard\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0applicants\u00a0and\u00a0learned\u00a0A.G.A.<br \/>\nThis\u00a0application\u00a0has\u00a0been\u00a0filed\u00a0with\u00a0a\u00a0prayer\u00a0to\u00a0quash\u00a0the\u00a0proceeding\u00a0<br \/>\nof\u00a0complaint\u00a0case\u00a0NO.\u00a03951\u00a0of\u00a02008\u00a0under\u00a0sections\u00a0379,\u00a0427\u00a0IPC\u00a0<br \/>\npending\u00a0in\u00a0the\u00a0court\u00a0of\u00a0learned\u00a0A.C.M.M.\u00a0Court\u00a0No.\u00a02,\u00a0Ghaziabad.<br \/>\nFrom \u00a0 the \u00a0 perusal \u00a0 of \u00a0 the \u00a0 impugned \u00a0 order \u00a0 it \u00a0 appears \u00a0 that \u00a0 learned\u00a0<br \/>\nMagistrate\u00a0has\u00a0taken\u00a0the\u00a0cognizance\u00a0and\u00a0summoned\u00a0the\u00a0applicant\u00a0<br \/>\nafter \u00a0 considering \u00a0 the \u00a0 complaint \u00a0 and \u00a0 statements \u00a0 recorded \u00a0 under\u00a0<br \/>\nsections\u00a0200\u00a0and\u00a0202\u00a0Cr.P.C.\u00a0which\u00a0discloses\u00a0the\u00a0offence\u00a0against\u00a0<br \/>\nthe\u00a0applicants.\u00a0There\u00a0is\u00a0no\u00a0illegality\u00a0or\u00a0irregularities\u00a0in\u00a0the\u00a0impugned\u00a0<br \/>\norder, \u00a0 therefore, \u00a0 the \u00a0 prayer \u00a0 for \u00a0 quashing \u00a0 the \u00a0 impugned \u00a0 order \u00a0 is\u00a0<br \/>\nrefused.\n<\/p>\n<p>However,\u00a0considering\u00a0the\u00a0submissions\u00a0made\u00a0by\u00a0learned\u00a0counsel\u00a0for\u00a0<br \/>\nthe\u00a0applicants,\u00a0it\u00a0is\u00a0directed\u00a0that\u00a0in\u00a0case\u00a0the\u00a0applicants\u00a0shall\u00a0appear\u00a0<br \/>\nbefore\u00a0the\u00a0court\u00a0concern\u00a0within\u00a020\u00a0days\u00a0from\u00a0today,\u00a0the\u00a0same\u00a0shall\u00a0<br \/>\nbe\u00a0heard\u00a0and\u00a0disposed\u00a0of\u00a0in\u00a0view\u00a0of \u00a0Smt.\u00a0Amrawati\u00a0and\u00a0another\u00a0Vs.\u00a0<br \/>\nState\u00a0of\u00a0U.P.\u00a02005\u00a0Cr.L.J.\u00a0755.\n<\/p>\n<p>The\u00a0Full\u00a0Bench\u00a0of\u00a0this\u00a0court\u00a0has\u00a0held\u00a0in\u00a0the\u00a0aforementioned\u00a0case:\n<\/p>\n<blockquote><p>     1. Even\u00a0if\u00a0a\u00a0cognizable\u00a0offence\u00a0is\u00a0disclosed\u00a0in\u00a0the\u00a0FIR\u00a0or\u00a0complaint\u00a0<br \/>\n        the\u00a0arrest\u00a0of\u00a0the\u00a0accused\u00a0is\u00a0not\u00a0a\u00a0must,\u00a0rather\u00a0the\u00a0police\u00a0officer\u00a0<br \/>\n        should \u00a0 be \u00a0 guided \u00a0 by\u00a0 the \u00a0 the \u00a0 decision \u00a0 of \u00a0 the \u00a0 Supreme \u00a0 Court \u00a0 in\u00a0<br \/>\n        Joginder \u00a0 Kumar \u00a0 Vs. \u00a0 State \u00a0 of \u00a0 U.P. \u00a0 1994 \u00a0 Cr.L.J. \u00a0 1981, \u00a0 before\u00a0<br \/>\n        deciding\u00a0whether\u00a0to\u00a0make\u00a0an\u00a0arrest\u00a0or\u00a0not.\n<\/p><\/blockquote>\n<blockquote><p>     2. The\u00a0High\u00a0Court\u00a0should\u00a0ordinarily\u00a0not\u00a0direct\u00a0any\u00a0Subordinate\u00a0Court\u00a0<br \/>\n        to \u00a0 decide \u00a0 the \u00a0 bail \u00a0 application \u00a0 the \u00a0 same \u00a0 day, \u00a0 as \u00a0 that \u00a0 would \u00a0 be\u00a0<br \/>\n        interfering\u00a0with\u00a0the\u00a0judicial\u00a0discretion\u00a0of\u00a0the\u00a0court\u00a0hearing\u00a0the\u00a0bail\u00a0<br \/>\n        application.\u00a0However,\u00a0as\u00a0stated\u00a0above,\u00a0when\u00a0the\u00a0bail\u00a0application\u00a0is\u00a0<br \/>\n        under\u00a0section\u00a0437\u00a0Cr.P.C.\u00a0ordinarily\u00a0the\u00a0Magistrate\u00a0should\u00a0himself\u00a0<br \/>\n        decide\u00a0the\u00a0bail\u00a0application\u00a0the\u00a0same\u00a0day,\u00a0and\u00a0if\u00a0he\u00a0decides\u00a0in\u00a0a\u00a0<br \/>\n        rare\u00a0and\u00a0exceptional\u00a0case\u00a0not\u00a0to\u00a0decide\u00a0it\u00a0on\u00a0the\u00a0same\u00a0day,\u00a0he\u00a0<br \/>\n        must \u00a0 record \u00a0 his \u00a0 reasons \u00a0 in \u00a0 writing. \u00a0 As \u00a0 regards \u00a0 the \u00a0 application\u00a0<br \/>\n        under \u00a0 section \u00a0 439 \u00a0 Cr.P.C. \u00a0 it \u00a0 is \u00a0 in \u00a0 the \u00a0 discretion \u00a0 of \u00a0 the \u00a0 learned\u00a0<br \/>\n        Sessions\u00a0Judge,\u00a0considering\u00a0the\u00a0facts\u00a0and\u00a0circumstances\u00a0whether\u00a0<br \/>\n        to\u00a0decide\u00a0the\u00a0bail\u00a0application\u00a0the\u00a0same\u00a0day\u00a0or\u00a0not,\u00a0and\u00a0it\u00a0is\u00a0also\u00a0in\u00a0<br \/>\n        his\u00a0discretion\u00a0to\u00a0grant\u00a0interim\u00a0bail\u00a0the\u00a0same\u00a0day\u00a0subject\u00a0to\u00a0the\u00a0final\u00a0<br \/>\n        decision\u00a0on\u00a0the\u00a0bail\u00a0application\u00a0later.\u00a0\n<\/p><\/blockquote>\n<p>The \u00a0 same \u00a0 has \u00a0 been \u00a0 approved \u00a0 by \u00a0 the \u00a0 Hon&#8217;ble \u00a0 Apex \u00a0 Court \u00a0 in \u00a0Lal\u00a0<br \/>\nKamlendra\u00a0Pratap\u00a0Singh\u00a0Versus\u00a0State\u00a0of\u00a0U.P.\u00a0on\u00a023.3.2009\u00a0in\u00a0Criminal\u00a0<br \/>\n Appeal\u00a0No.\u00a0538\u00a0of\u00a02009.\n<\/p>\n<p>With\u00a0this\u00a0direction,\u00a0this\u00a0application\u00a0is\u00a0finally\u00a0disposed\u00a0of.<br \/>\nOrder Date :- 28.1.2010<br \/>\nRPD\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Pankaj Sharma And Another vs State Of U.P.
