Variava &amp; Arun Kumar\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>Variava, J.\n<\/p>\n<p>\tThis appeal is against the judgment dated 8th October, 1993.\n<\/p>\n<p>Briefly stated the facts are as follows:\n<\/p>\n<p> The case of the prosecution was that on 21st September, 1991, 10 persons<br \/>\n(who were arraigned as accused before the trial Court), formed an unlawful<br \/>\nassembly and committed murder of one Pamula Narayan.  It is the case of<br \/>\nthe prosecution that they committed theft of Rs.8,000\/- from the person of<br \/>\nthe deceased and also attacked and caused injuries to the wife of the<br \/>\ndeceased and committed theft of ear-studs of the wife of the deceased.\tThe<br \/>\n10 accused were therefore charged for offences under Section 148, 324, 326,<br \/>\n379 and 302 IPC.  Unfortunately no charge was framed either under Section<br \/>\n34 or 149 IPC.\n<\/p>\n<p>\tThe only eye-witness account was that wife of the deceased. She was<br \/>\nexamined as PW.1.  She deposes that Accused No.1 (who is Respondent<br \/>\nNo.1 here)  hacked the deceased on the left side of the fore-head and below<br \/>\nthe left knee-joint.  She deposes that Accused No.2 (who is Respondent No.3<br \/>\nhere) hacked the deceased on the right side fore-head and on right shoulder.<br \/>\nShe deposes that Accused No.6 (who is Respondent No.4 herein) hacked the<br \/>\ndeceased on the head and left side of the fore-head.  She deposes that<br \/>\nAccused No.3 hit the deceased with an axe on the right side ribs.  Thus she<br \/>\nattributes overt acts to each of these four persons.  She specifies the injuries<br \/>\ncaused by each one of them.\n<\/p>\n<p>The Doctor who conducted the post-mortem was examined as PW.10.<br \/>\nThe post-mortem report shows the following injuries:\n<\/p>\n<p>&#8220;External injuries:\n<\/p>\n<p>1.\tIncised injury 2&#215;1\/2&#215;1\/2 inches over left parietal region.\n<\/p>\n<p>2.\tIncised injury 1\/2&#215;1\/4&#215;1\/4 inches over right side of fore<br \/>\nhead.\n<\/p>\n<p>3.\tSkin contusion red, 1&#215;1\/4&#8243; over left side of the forehead.\n<\/p>\n<p>4.\tSkin contusion 1&#215;1 inches over left shoulder,\n<\/p>\n<p>5.\tTwo skin contusions red in colour each 2&#8243;x1&#8243; over<br \/>\nlumbar vertebra.\n<\/p>\n<p>6.\tSkin contusion 1&#215;1 inches over posterior border of left<br \/>\naxilla.\n<\/p>\n<p>7.\tSkin contusion 1&#215;1 inches over middle 1\/3rd of posterior<br \/>\naspect of left arm red in colour.\n<\/p>\n<p>8.\tMultiple small abrasions over lower 1\/3rd of right side of<br \/>\nchest.\n<\/p>\n<p>9.\tAbrasion 1\/2&#8243; long just below posterior aspect of right<br \/>\nelbow.\n<\/p>\n<p>10.\tSkin contusion 1\/2 x 1\/2 inches red in colour over lateral<br \/>\naspect of lower 1\/3rd of right fore arm.\n<\/p>\n<p>11.\tLaceration 1\/2 x1\/4 inches x 1\/2 inches over posterior<br \/>\naspect of left elbow.\n<\/p>\n<p>12.\tSkin contusion, red 1\/2&#215;1\/2 inches over posterior aspect<br \/>\nof left elbow.\n<\/p>\n<p>13.\tSkin contusion red in colour 1\/2 x 1\/2 inches over lateral<br \/>\naspect of upper 1\/3rd of left thigh.\n<\/p>\n<p>14.\tThree skin contusions red in colour each 1\/2&#215;1\/2 inches<br \/>\nover laterial aspect of left knee.\n<\/p>\n<p>15.\tAbrasion 3&#8243; long over upper 1\/3rd of on front of right<br \/>\nthigh.\n<\/p>\n<p>16.\tSkin contusion 1&#215;1 inch red over right knee\n<\/p>\n<p>17.\tSkin contusion red 2&#215;2 inches over lateral aspect of<br \/>\nlower part of right side of chest\n<\/p>\n<p>18.\tSkin contusion red 1&#215;1 inches with multiple small<br \/>\nabrasions over posterior part of middle 1\/3rd of right side<br \/>\nof chest.\n<\/p>\n<p>Internal appearances:-\n<\/p>\n<p>12th rib is fractured over right side with injury to IVC.  (inferior<br \/>\nVena Cava).  Blood clots and blood are found in abdominal<br \/>\ncavity volume about 3 litres.  Stomach is empty.  Other internal<br \/>\norgans like heart, lungs, liver, spleen, kidneys and intestines are<br \/>\nnormal.\t Brain is normal.&#8221;\n<\/p>\n<p>\tThe Doctor opined that the death was due to acute haemorrhage and<br \/>\nshock due to injury to the inferior vena cava. The Doctor does not depose,<br \/>\nand there is no evidence, that any of the other injuries and particularly<br \/>\ninjuries No.1 and 2 were such that in the normal course would have resulted<br \/>\nin death. As noted above in the opinion of the Doctor death was a result of<br \/>\nthe blow to the rib of the deceased.  That blow, according to the deposition<br \/>\nof PW.1, was given by Accused No.3.\n<\/p>\n<p>\tThe trial Court acquitted all except A-1, A-2 and A-6, (i.e., three<br \/>\nRespondents before this Court).\t We have read the judgment of the trial<br \/>\nCourt.\tThe trial Court has believed the evidence of PW.1 i.e. the eye-<br \/>\nwitness.  We cannot  fanthom how A-3 was still acquitted by the trial Court.<br \/>\nWe also find that the trial Court has convicted these three Respondents<br \/>\nunder Section 302 simplicitor i.e. without the aid of Section 34 or 149 IPC.<br \/>\nThe trial Court also convicted them under Sections 324 and 379 IPC also.\n<\/p>\n<p>\tThe State filed no appeal against the acquittal of the other accused<br \/>\npersons.  The Appellant also did not file any Appeal.  The Respondents<br \/>\n(herein) filed an Appeal against their conviction.  The High Court also<br \/>\nbelieved the evidence of PW.1.\tThe High Court\tthen held as follows:\n<\/p>\n<p>&#8220;Most of the injuries found are on non-vital parts of the<br \/>\ndeceased and they are simple.  As such we find that they cannot<br \/>\nbe said to have intended to cause the death or would have had<br \/>\nthe knowledge that the injuries caused by them would result in<br \/>\nthedeath of the deceased.  We, therefore, find the appellants<br \/>\nguilty of offence under Sec.324 IPC.&#8221;\n<\/p>\n<p>\tThe High Court then set aside the conviction under Section 302 but<br \/>\nmaintained sentence under Section 324 and sentenced them for a period of<br \/>\ntwo years.  The High Court also maintained the sentence under Section 379<br \/>\nand sentenced them for a period of two years.\n<\/p>\n<p>\tThe State has not filed any Appeal.  However, the Appellants have<br \/>\ncome to this Court against the judgment of the High Court.  As noted above,<br \/>\nthe overt act, which resulted in death, was attributed to Accused No.3.\t He<br \/>\nhas been acquitted.  No Appeal was filed against that acquittal.  This Court,<br \/>\ncannot, at this stage interfere with that acquittal.  The Respondents (herein)<br \/>\nwere not charged under Section 302 read with Section 34 or Section 149<br \/>\nIPC.  The High Court was thus right in setting aside their conviction under<br \/>\nSection 302 IPC.  The High Court is obviously referring to injuries other<br \/>\nthan the one on the rib when it states that they are on non-vital parts.  By<br \/>\nterming the other injuries as simple the High Court is obviously meaning<br \/>\nthat they are not grievous as defined in Section 320 IPC.  Also the High<br \/>\nCourt has obviously kept in mind the fact that there is no evidence on record<br \/>\nthat any of the other injuries were such as would, in the ordinary course,<br \/>\nhave resulted in death.\t  Thus, we see no reason to interfere with the<br \/>\nconviction.  However, in our view, this is a fit case where the High Court<br \/>\nshould have imposed fine upon the Respondents and should have invoked<br \/>\nthe provision of Section 357 of\t the Code of Criminal Procedure.  It is<br \/>\nproved that Respondents were responsible for theft of Rs.8,000\/- and ear<br \/>\nstuds of PW.1.\tPW.1 has also lost her husband who was the main earning<br \/>\nmember.\t Therefore, over and above the sentence imposed by the High<br \/>\nCourt, we also impose fine on each of the Respondents in a sum of<br \/>\nRs.10,000\/- (ten thousand) each.  In default of payment of fine they shall<br \/>\nundergo a further period of one year each.
