The petitioners submits that the respondents<\/p>\n<p>                   vide Letter no. 1173 dated 15.11.2006 have decided to<\/p>\n<p>                   take over the land situated at Sasaram from Rauja Road<\/p>\n<p>                   to Katchari Petrol Pump and further to allot the shops to<\/p>\n<p>                   the people by general auction after developing the said<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>plot upon which the petitioners were doing             their<\/p>\n<p>business of selling vegetables and fruits.<\/p>\n<p>          The petitioners state that they are small time<\/p>\n<p>vegetable vendors since more than 20 years and have<\/p>\n<p>been selling fruits and vegetables on the sides of the<\/p>\n<p>drain, spread from Rauja Road to Kutchery. They also<\/p>\n<p>pay toll tax to the respondents. Grievance of the<\/p>\n<p>petitioners is that the respondents are auctioning the said<\/p>\n<p>place in stead of allotting it to them. The petitioners<\/p>\n<p>submit that economically they are weak and cannot<\/p>\n<p>compete with affluent bidders.\n<\/p>\n<p>          Respondents have filed counter affidavit. They<\/p>\n<p>state   that with a view to smoothen the traffic and<\/p>\n<p>beautify the area around Shershah Tomb, Government<\/p>\n<p>has carved out a scheme where the allotment would be<\/p>\n<p>made through open auction.        He further submits that<\/p>\n<p>any person intending to get allotment in the proposed<\/p>\n<p>space, would be given opportunity.\n<\/p>\n<p>          Nagar Parishad would be within its own right<\/p>\n<p>to bring out scheme for settlement of space by auction.<\/p>\n<p>The petitioners may approach respondent no.3 for giving<\/p>\n<p>alternative   space     which     may        be   considered<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>          sympathetically.\n<\/p>\n<p>                    The writ petition stands disposed of.<\/p>\n<p>Shashi.
