SAHAI\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE KS JHAVERI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate<\/a>\n: 18\/10\/2011 \nORAL JUDGMENT<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE KS JHAVERI)<\/p>\n<p>\t\tBy<br \/>\nway of this Intra-Court Letters Patent Appeal, the appellants &#8211;<br \/>\noriginal petitioners have challenged the judgment and order dated<br \/>\n14.10.2010 passed by the Learned Single Judge in Special Civil<br \/>\nApplication No.10769 of 2010 whereby the Learned Single Judge<br \/>\ndismissed the writ petition filed by the appellants on the ground of<br \/>\ndelay and laches.\n<\/p>\n<p>2.\t\tThough<br \/>\nthe present Letters Patent Appeal as well as Civil Application are<br \/>\nlisted for admission, with the consent of learned counsel for the<br \/>\nparties, we have taken up the appeal as well as Civil Application for<br \/>\nfinal disposal.\n<\/p>\n<p>3.\t\tWe<br \/>\nhave heard Mr. N. J. Shah, learned Assistant Government Pleader<br \/>\nappearing for the appellants and Mr. Bipin Jasani, learned counsel<br \/>\nappearing for the respondent No.1.\n<\/p>\n<p>4.\t\tThe<br \/>\nwrit petition was filed by the appellants challenging the judgment<br \/>\nand order dated 16.09.2009 passed by the Gujarat Higher Secondary<br \/>\nSchools Services Tribunal at Ahmedabad in Application No.136 of 2007.<br \/>\n The writ petition was filed on 23.08.2010.  The Learned Single Judge<br \/>\ndismissed the writ petition only on the ground of delay and laches.<br \/>\nIn our view, the Learned Single Judge ought to have decided the<br \/>\nmatter on merits.  Hence, the present Letters Patent Appeal deserves<br \/>\nto be allowed.\n<\/p>\n<p>5.\t\tIn<br \/>\nthat view of the matter, the present Letters Patent Appeal is<br \/>\nallowed.  The judgment and order dated 14.10.2010 passed by the<br \/>\nLearned Single Judge in Special Civil Application No.10769 of 2010 is<br \/>\nquashed and set aside.  Special Civil Application No.10769 of 2010<br \/>\nis remanded back to the Learned Single Judge for deciding the same on<br \/>\nmerits.  It is made clear that this Court has not gone into the<br \/>\nmerits of the matter and has not expressed any opinion on the merits<br \/>\nof the matter.\n<\/p>\n<p>6.\t\tThe<br \/>\nLearned Single Judge is requested to decide the writ petition on<br \/>\nmerits expeditiously, subject to His Lordship&#8217;s convenience.\n<\/p>\n<p>7.\t\tIn<br \/>\nview of disposal of appeal, Civil Application also stands disposed<br \/>\nof.\n<\/p>\n<p>\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t[V.
