Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :26\/03\/2009\n\n O R D E R\n              THOTTATHIL B RADHAKRISHNAN, J\n                 ...........................................\n                WP(C).NO. 9495                  OF 2009\n                 ............................................\n        DATED THIS THE          26TH DAY OF MARCH, 2009\n\n                               JUDGMENT\n<\/pre>\n<p>     Kerala State Co-operative Examination Board is impleaded.<\/p>\n<p>Heard learned counsel for the petitioner and learned standing<\/p>\n<p>counsel, Adv.P.U.Shylajan for second respondent. Notice to first<\/p>\n<p>respondent dispensed with preserving the right to move for<\/p>\n<p>review of this judgment, if aggrieved. The petitioner, going by<\/p>\n<p>Exts.P1, P2 and P3, had different laps of temporary employment<\/p>\n<p>on daily wages with the second respondent. With the passage of<\/p>\n<p>time, the Co-operative Examination Board,                invited applications<\/p>\n<p>to the post of Junior Clerk in the second respondent, along with<\/p>\n<p>other banks. Test was conducted by the Board and list has been<\/p>\n<p>forwarded to the society to conduct interview. It is stated that<\/p>\n<p>interview has also been conducted. After the introduction of<\/p>\n<p>Section 80(B) in the        Kerala Co-operative Societies Act, the<\/p>\n<p>recruitment of a regular entrant can be made only following the<\/p>\n<p>procedure as noted above. The petitioner cannot therefore insist<\/p>\n<p>on regularising her temporary appointments. It would also be<\/p>\n<p><span class=\"hidden_text\">WP(C) 9495\/2009                      2<\/span><\/p>\n<p>unfair to other competing candidates if this court were to issue<\/p>\n<p>any direction as sought for, viz, that the experience earned by<\/p>\n<p>the petitioner should also be considered.    These are matters left<\/p>\n<p>entirely with the realm of the Examination Board and the<\/p>\n<p>employer of the second respondent to make selection in<\/p>\n<p>accordance with the directions of Kerala Co-operative Societies<\/p>\n<p>Act and Rules and binding directions issued under those statutory<\/p>\n<p>provisions.
