No.72 of 2011 in\n                       RCR No.4 OF 2011\n                      ------------------------\n\n            Dated this the 1st day of February , 2011\n\n\n                           JUDGMENT\n<\/pre>\n<p>Pius C.Kuriakose, J.\n<\/p>\n<\/p>\n<p>      We have heard Sri.K.A.Abdul Salam, learned counsel for the<\/p>\n<p>review petitioners\/landlords and Sri.M.P.Madhavan Kutty, learned<\/p>\n<p>counsel for the respondent\/tenant in extenso.          We    have<\/p>\n<p>considered the submissions addressed by the learned counsel.<\/p>\n<p>We have also gone through the materials placed on record,<\/p>\n<p>particularly Annexures A1 an A2. We are of the view that our<\/p>\n<p>order dated 5\/1\/2011 sought to be reviewed by the landlords<\/p>\n<p>requires to be reviewed to a certain extent. The result of the<\/p>\n<p>Review Petition, accordingly, will be as follows;<\/p>\n<p>      i).  The decision to confirm the order of eviction passed by<\/p>\n<p>the Rent Control Court and confirmed by the Appellate Authority<\/p>\n<p>will stand.\n<\/p>\n<p>      ii). The decision under our order to grant to the revision<\/p>\n<p>petitioner tenant time till 14\/8\/2011 will be subject to modified<\/p>\n<p><span class=\"hidden_text\">R.P..No.72\/2011                  2<\/span><\/p>\n<p>conditions.   The condition incorporated in our order that the<\/p>\n<p>petitioner\/tenant should file an affidavit within two weeks from<\/p>\n<p>5\/1\/2011       undertaking that      he will    surrender   vacant<\/p>\n<p>possession of the building       to the landlords on or before<\/p>\n<p>14\/8\/2011     and that he will pay occupation charges at the<\/p>\n<p>current rent rate as and when the same falls due will stand<\/p>\n<p>deleted and will be substituted by the following conditions;<\/p>\n<p>      The revision petitioner\/tenant shall file an affidavit on or<\/p>\n<p>before 7\/2\/2011 before the Execution Court          undertaking as<\/p>\n<p>follows;\n<\/p>\n<blockquote><p>          &#8220;that he will pay a total amount of Rs.9,000\/-<\/p>\n<p>          to the landlords either directly or through their<\/p>\n<p>          counsel in the Execution Court          towards<\/p>\n<p>          damages for use and occupation and interest<\/p>\n<p>          for the building for the period till 7\/1\/2011.<\/p>\n<p>          It will also be undertaken through the same<\/p>\n<p>          affidavit that he will pay occupation charges<\/p>\n<p>          for the building for the period subsequent to<\/p>\n<p>          7\/1\/2011 till 14\/8\/2011        at the rate of<\/p>\n<p>          Rs.2,500\/- per mensem.
