No.19604 of 2011\n                                          NAGINA NUTT\n                                               Versus\n                                       The State Of Bihar\n                                             -----------\n<\/pre>\n<p>2       12-07-2011              Heard learned counsel for the petitioner as well as<\/p>\n<p>                     learned Additional Public Prosecutor for the state.<\/p>\n<p>                                Petitioner   is languishing    in   jail   custody   since<\/p>\n<p>                     02.06.2008 in a case registered under sections-396 &amp; 397 of the<\/p>\n<p>                     Indian Penal Code. It would appear from perusal of the<\/p>\n<p>                     impugned order that charge sheet was submitted against the<\/p>\n<p>                     petitioner showing him an absconder.\n<\/p>\n<p>                                Admittedly, the petitioner is neither named in the first<\/p>\n<p>                     information report nor anything has been recovered from his<\/p>\n<p>                     conscious possession and except the criminal antecedent of the<\/p>\n<p>                     petitioner, there is nothing against him. Moreover, having more<\/p>\n<p>                     or less similar allegation, several co-accused persons have<\/p>\n<p>                     already been granted privilege of bail by this court.<\/p>\n<p>                                Taking into consideration the aforesaid facts and<\/p>\n<p>                     circumstances as well as submission of the parties, let the<\/p>\n<p>                     petitioner, namely, Nagina Nutt be released on bail on furnishing<\/p>\n<p>                     bail bonds of Rs 10,000\/- (ten thousand) with two sureties of the<\/p>\n<p>                     like amount each in connection with Sessions Trial No. 12 of<\/p>\n<p>                     2011\/06 of 2011 arising out of Ghosi (Ikri) P.S. Case No. 54 of<\/p>\n<p>                     2005 to the satisfaction of Addl.
