S.J. MUKHOPADHAYA)<\/p>\n<p>\tPursuant<br \/>\nto the Court&#8217;s order dated 22.4.2011, the respondent &#8211; bank has<br \/>\nfiled an affidavit enclosing a copy of the record of Cash Credit<br \/>\nAccount No. 351 and Term Loan Account No. 142\/1\/14, as appearing in<br \/>\nthe name of the appellant, wherein debit and credit of total amounts<br \/>\nhave been shown.\n<\/p>\n<p>\tWith<br \/>\na view to find out whether the amount has been properly calculated,<br \/>\nas there appears to be genuine dispute, we are of the view that the<br \/>\nmatter should be verified by an officer of a nationalized bank viz.<br \/>\nState Bank of India branch running in the premises of the High Court.<br \/>\n We request the Branch Manager, State Bank of India, High Court<br \/>\nBranch to get the documents verified through any of its officers to<br \/>\nfind out whether the respondent &#8211; Rajkot Nagarik Sahakari Bank<br \/>\nLtd. has made proper calculation of the debit and credit of the total<br \/>\namounts and what is the amount due and payable by appellant &#8211;<br \/>\nJayesh Hemantbhai Joshi in favour of Rajkot Nagarik Sahakari Bank<br \/>\nLtd.\n<\/p>\n<p>\tThe<br \/>\nappellant and the officer of Rajkot Nagarik Sahakari Bank Ltd. will<br \/>\nreport to the Branch Manager, State Bank of India, High Court Branch<br \/>\non or before 16.5.2011, when the said Officer will fix a date.  The<br \/>\nOfficer of Rajkot Nagarik Sahakari Bank Ltd. will produce all the<br \/>\nrelevant records, if necessary, for the said purpose before the<br \/>\nOfficer as may be authorized by the Branch Manager, State Bank of<br \/>\nIndia, High Court Branch on the date as may be fixed by the Branch<br \/>\nManager.  The Office will also find out whether any penal interest on<br \/>\ninterest was charged by the respondent &#8211; Rajkot Nagarik Sahakari Bank<br \/>\nLtd.\n<\/p>\n<p>\tIt<br \/>\nis expected that a report, after proper calculation, will be<br \/>\nsubmitted by the Branch Manager, State Bank of India, High Court<br \/>\nBranch by 8th June, 2011.\n<\/p>\n<p>\tThe<br \/>\nCourt may decide whether any amount is to be paid to the officer who<br \/>\nmade such calculation at the instance of the parties.\n<\/p>\n<p>\tLet<br \/>\na copy of this order be handed over to the learned counsel for the<br \/>\nappellant and Rajkot Nagarik Sahakari Bank Ltd., who will produce the<br \/>\nsame before the Branch Manager, State Bank of India, High Court<br \/>\nBranch.\n<\/p>\n<p>\tPost<br \/>\nthe matter on 16th June, 2011 within ten cases.\n<\/p>\n<p>\t\t\t\t\t\t[S.\n<\/p>\n<p>J.
