Prasad,CJ<br \/>\nHon&#8217;ble Pankaj Mithal,J<\/p>\n<p>       This application has been filed for condoning the<br \/>\ndelay in filing the appeal.\n<\/p>\n<p>       According to the Stamp Reporter, appeal is barred by<br \/>\nlimitation by 109 days.\n<\/p>\n<p>       Various reasons, which prevented the appellant from<br \/>\nfiling the special appeal within time have been enumerated<br \/>\nin the affidavit filed in support of the delay condonation<br \/>\napplication.\n<\/p>\n<p>       We are of the opinion that the same constitute<br \/>\nsufficient cause for condoning the delay.\n<\/p>\n<p>       Accordingly, delay in filing the appeal is condoned.<br \/>\n       Application stands allowed.<\/p>\n<pre>\n\n\nDate: 13.01.2010\nRK\/                                         (C.K. Prasad,CJ<br \/>\nHon&#8217;ble Pankaj Mithal,J<\/p>\n<p>       Writ petitioner-appellant, aggrieved by order dated 21.8.2009<\/p>\n<p>passed by a learned Single Judge in Civil Misc. Writ Petition No. 10179<\/p>\n<p>of 1993, has preferred this appeal under Rule 5 Chapter VIII of the High<\/p>\n<p>Court Rules.\n<\/p>\n<p>       Mr. Rahul Mishra appears on behalf of the appellant. Mr. R.B.<\/p>\n<p>Singhal, Assistant Solicitor General of India along with Mr. S.K. Rai<\/p>\n<p>appears for Union of India.\n<\/p>\n<p>       Writ petitioner-appellant (hereinafter referred to as &#8216;petitioner&#8217;) was<\/p>\n<p>a candidate for appointment as Airman (Technical) in the Indian Air<\/p>\n<p>Force. By order dated 17.1.1990, he was declared temporary medically<\/p>\n<p>unfit and the representation against the aforesaid order, was ultimately<\/p>\n<p>dismissed by order dated 19.11.1992. The petitioner challenged the<\/p>\n<p>aforesaid order in the writ application. The learned Single Judge by the<\/p>\n<p>impugned order had quashed the order impugned in the writ petition but<\/p>\n<p>declined to direct consideration of his case for appointment instead he<\/p>\n<p>directed for payment of compensation of Rs. 1.00 lac and Rs.25,000\/- as<\/p>\n<p>cost of litigation.\n<\/p>\n<p>       Petitioner, aggrieved by the order by which the learned Single<\/p>\n<p>Judge has declined to direct consideration of his case for appointment,<\/p>\n<p>the quantum of compensation and the cost of litigation, has preferred this<\/p>\n<p>appeal.\n<\/p>\n<p>       Mr. Rahul Mishra, appearing on behalf of the petitioner, submits<br \/>\n that age of retirement of Airman (Technical) is 57 years and the<\/p>\n<p>petitioner having attained the age of 37 years only, nothing prevented this<\/p>\n<p>Court to direct for consideration of his case for appointment.<\/p>\n<p>      We do not find any substance in the submission of Mr. Mishra. The<\/p>\n<p>learned Single Judge has taken into account that appointment is in the<\/p>\n<p>Indian Air Force and the petitioner having attained the age of 37 years<\/p>\n<p>had crossed the upper age limit for appointment. Not only this, for being<\/p>\n<p>the member of the Force, certain training is required to be given. Taking<\/p>\n<p>into account the aforesaid fact, the learned Single Judge declined to<\/p>\n<p>direct for reconsideration of his case for appointment. We are of the<\/p>\n<p>opinion that exercise of discretion does not suffer from any error calling<\/p>\n<p>for interference in the appeal.\n<\/p>\n<p>      Mr. Mishra then submits that petitioner ought to have been granted<\/p>\n<p>higher compensation and cost. It is well settled that grant of<\/p>\n<p>compensation and cost is within the discretion of the Court and such<\/p>\n<p>order is not interfered in the appeal unless it suffers from any perversity.<\/p>\n<p>      We are of the opinion that grant of compensation to the extent of<\/p>\n<p>Rs. 1.00 lac and cost of Rs. 25,000\/- to the petitioner does not suffer<\/p>\n<p>from any error.\n<\/p>\n<p>      It is relevant to state that     against the grant of compensation,<\/p>\n<p>Union of India has preferred Special Appeal (D) No. 1252 of 2009,<\/p>\n<p>which has been dismissed by order dated 26.11.2009.<\/p>\n<p>      We do not find any merit in the appeal and it is dismissed<\/p>\n<p>accordingly.<\/p>\n<pre>\n\nDate: 13.01.2010\nRK\/                               (Pankaj Mithal,J)      (C.K.
