 virtually became disabled completely.<\/p>\n
 There_fo:re, he preferred a claim petition claiming<\/p>\n
 vco\ufb01zpensation for the injuries sustained.<\/p>\n

4. After service of notice, the first respondent<\/p>\n
did not appear. He was placed eX–parte. 2nd resLpond,e’n.t<\/p>\n
— Insurance Company filed statement   <\/p>\n
contesting the claim. However, :hey”did’i.not\u00ab <\/p>\n
accident and the insurance coV’erag_e of<\/p>\n
question.\n<\/p>\n
5. On the aforeisaidp.’ -tribunal framed<\/p>\n
the following three issues:  V<\/p>\n
1.   proves that the
\niiii   in~_c1uestio’n'”occurred due to rash
\n”  of the driver of the
\n bearing Registration<\/p>\n
  and Ashok Layiand Truck<\/p>\n
hearing””Registration No.KA 01-13–4524, as a
\n  of which, the petitioner sustained<\/p>\n
V ‘ dries?\n<\/p>\n
Whether the petitioner entities for<\/p>\n
DJ:\n<\/p>\n
compensation as claimed by him? If not
\nwhat is the quantum of compensation he<\/p>\n
entities for and from whom?\n<\/p>\n

6. In order to substantiate the claim, oribuehalf<\/p>\n
of the claimant, his father Sripati
\nexamined as PW-1. His wife ‘*
\nDr.Ravish Tunga who treated hiin\n<\/p>\n

\nas Ex.P1 to Ex.P193._.  On ir’esi.r)Aon,dents, no<\/p>\n
evidence was adduced.’ ‘  ‘   f<\/p>\n
 ._  on consideration of the<\/p>\n
aforesaid1natveria1i”or1~  held, that the claimant has<\/p>\n
estapiished that\ufb02the accident was on account of the<\/p>\n
‘   ‘n:egi__igent driving by the driver of the lorry in<\/p>\n
q.uestionu–“.’f–:are1d therefore, actionable negligence is<\/p>\n
 estoblisioed. Thereafter, it took note of the injuries<\/p>\n
A  xsuistained by the claimant. The wound certificate<\/p>\n
discloses that the claimant has sustained two cut<\/p>\n
lacerated sutured wounds, injuries to the chest lung<\/p>\n
R\/.\n<\/p>\n
contusion on left side and left arm swelling presentover
\nthe left arm and left shoulder with humorou.s’.ifrre:’sen4t
\nmiddle 1 \/3113 of scalp of left humorous
\nangulalion. He also sustained injuries  :i\u00ab’.ei.’,”.
\nparietal region. C.T. Scan was if
\nhe sustained diffuse    also
\nsustained grievous injuries    The
\nmovement was restricted”;  at Andhara,
\nrehabilitation’    challenged.\n<\/p>\n
Because  “injury sustained, he
\nhas  person. It took the
\nincomeiiiiofii  Rs.3,000\/– per month.<\/p>\n
Doctor ej\/idieri-oei’diiscl’oses 65% of the disability for the<\/p>\n
 “However, the tribunai took it as 50% to the<\/p>\n
i”‘w_h7o_lex   multiplier 14. Thus awarded a sum<\/p>\n
of \/– towards pain, agony, trauma and injury<\/p>\n
-.i’:a:nd..suffering, Rs.l,50,000\/– towards medical expenses<\/p>\n
 “other incidental charges like conveyance, food,<\/p>\n
Ws”;i)ecia.1 diet, attendant charges, nutrition, Rs.20,000\/\u00ab~<\/p>\n
iv.\n<\/p>\n
towards loss of amenities, Rs.2,52,000\/– towards loss of
\nfuture income due to disability and
\ntowards future medical expenses. Thus,
\nRs.5,02,000\/- is awarded. 1,.\/-kggr.ieve’_diiihhvhf,
\njudgment and award, the<\/p>\n
appeal.\n<\/p>\n
8. He has  ii application for
\nadditional eviclerzce.   of hearing in
\n this Court, he was
\nkept learned Judges have
\nobserved    ”  i <\/p>\n
  a look at the claimant-\n<\/p>\n
  is totally disabled from any
\nmovement and without an aid or<\/p>\n
 he cannot even move an inch”\n<\/p>\n
The additional evidence produced in this appeal<\/p>\n
 itdiscloses that the ciairnant is under treatment of<\/p>\n

V.\n<\/p>\n
Hence, we allow the application for additional evidence
\nas they are subsequent documents and are <\/p>\n
for deciding the claim of the appellant.<\/p>\n
9. The learned counlseil
\nassailing the impugned jtidgrnentaxiandp
\nthe disability incurred by  account of
\naccident is now V1609\/o  from the
\nobservations  tY1i;\u00a7'”as the records
\nproducecii, ivirpl     deteriorating from<\/p>\n
_i”‘i’h1e,rei’ore{the -.trViVb=.:’1nal was not justified in<\/p>\n
day to i–day’.v.r
\ntaking the  disability at 50% to the whole
\nbody,  it as 100%. Secondly, he<\/p>\n
c._ofitendsVp_ he Awasmavprogressive former. The income of<\/p>\n
V  is that of an unskilled labourer. He<\/p>\n
‘got arecaiiplantations. He had introduced venilla in this<\/p>\n
area and he was also growing rubber. He was aged<\/p>\n
it ~.ab’cut 41 years. in those circumstances, the income<\/p>\n
taken at Rs.3,000\/\u00bb is on the lower side and it ought to<\/p>\n
te\/”\n<\/p>\n
_iO-\n<\/p>\n
have enhanced. Thirdly, he contended he cannot live
\nwithout attendants and therefore, this attendant<\/p>\n
charges has to be incurred by the family throughou’t._Vhis<\/p>\n
life and no compensation is awarded,\u00a7’_”for~i..’_ffutL1re_<\/p>\n
attendant charges which ought to have””oee_nddgraiiiteid.”<\/p>\n
He further contended the doctor cje1*tificsa.te~ s13ow’s._Ath,at<\/p>\n
about Rs.4,000\/– to 5,000!\/r;’..QUg1;1′[\u00bb. to be i’ino\u00bb;i;e;~gd..every.V:i’<\/p>\n
month towards medicines,….vv:’Therefore;t.t,heJaward of
\nRs.25,000\/- towards”4″futL1re__i’nedi’ca1..expenses is wholly<\/p>\n
inadequate. vL:ast_1y,  thatVV’Vthe claimant has<\/p>\n
become  Theirefotjegddian award of Rs.25,000\/~\u00bb
\ntowards.__1″oss   is on the lower side and<\/p>\n
therefore, ‘the a substantial enhancement of<\/p>\n
 \u00abcompensation ought to be awarded.<\/p>\n
 ~  contra, the learned Counsel for the<\/p>\n
 supported the impugned award.\n<\/p>\n

11. From the aforesaid facts, it is clea_1f_,_’ the
\nclaimant was aged about 41 years on the date
\naccident. He was an agriculturist. He owiied
\ngarden. He was cultivating
\nintroduced Venilla. According
\nearning Rs. 150,000\/– periannrum. “He, social’
\nworker in his village.  rrierriiberg of the<\/p>\n
Balatnandira in Neernalli.  of the injuries<\/p>\n
sustained,  ud_i,saloled and all his
\nactivities   medical evidence on
\nrecord’  he suffered three
\ninjuries sutured wounds, tenderness<\/p>\n
was” “present govier  left side of the chest and<\/p>\n
 tenderriess’\u00ab,__was present over the left arm, swelling<\/p>\n
 the left arm and left shoulder with<\/p>\n
hu’1norious’;i present middle 1\/ 3” of scalp of left<\/p>\n
  “‘r1u,rr1or’ous with lateral angulalion. After the accident he<\/p>\n
 shifted to Bapuji Hospital, Davangere. Thereafter,<\/p>\n
11 “he was taken to Nimhans Hospital, Bangalore for<\/p>\n
kw\/,,.,<\/p>\n

\ntreatment of head injuries. After prolonged intermittent
\ntreatment, he was also taken to Ajit Manochetana
\nHospital, Sirsi and also to Dr.Samba Murthy,vat_iSirsi.<\/p>\n
As there was no improvement in the menta\u00a7l””Stia’tu:s’,  _<\/p>\n
was taken to SCS Hospital, Mangalorem-:.::jWhen’–AVtl1,at”<\/p>\n
treatment did not yield any result, nad,_beenit’aker1::,to<\/p>\n
Manasa Nursing Home, Shi’In,oga.”v. In tIiep1*ocess, he,’<\/p>\n
has lost his memory and____he__’nas bec.ome_ii mentally
\nimbalanced and unable’ to   his day to day work
\nand he requiires  to keep his<\/p>\n
mental conci._iti_on.,% as:”~s_tabl_*e. If the medicines are
\ndiscontinuedifor ‘=ai1y””\u00abre’a’son, he becomes violent and<\/p>\n
wo1;11d_be difficult to control him for some time. The<\/p>\n
  treated the claimant at SCS Hospital,<\/p>\n
   been examined. He has categorically<\/p>\n
stated—i:that the claimants present mental condition is<\/p>\n
 , ”pce.rrnanent in nature. It cannot be improved. He has to<\/p>\n
iiijundergo treatment for the said problem throughout his<\/p>\n
it it “life. According to him, the disability is 65% to the Whole<\/p>\n

\nbody. The records also disclose that a sum of
\nRs.70,9-41\/– has been spent towards purchase of
\nmedicines as prescribed by the doctors. to
\nEXP183 are the receipts showing
\nexpenditure. The additional e\\_r_ide.nce
\ncase discloses that he is
\n“Andhara”, rehabilitation  for”rrientgii:1i_yi”ch’ai1er1ged’.’V: T’
\nThe observations of this Court”p_:rel’orred to-aboive makes
\nit clear he is  he was not<\/p>\n
examined i_n~.t_h–e case,  “unable to depose.<\/p>\n
Therefore,l”his _yfather.i”a_nd._ wife are examined. Under
\nthese circuInst_ances,””Wei.”are of the View keeping the<\/p>\n
income. of lithe; claimant at Rs.3,000\/– as taken by the<\/p>\n
   award a sum of Rs.2,52,000\/– in addition<\/p>\n
 . awarded by the tribunal towards loss of<\/p>\n
fiiture-5 :ir1corr1e\/ permanent disability treating the case as<\/p>\n
  “1VOQ”\/oiifunctional disability for the Whole body. Now, the<\/p>\n
bexridence on record clearly establishes he cannot move<\/p>\n
iiiwithout any aid of attendant that would be the position<\/p>\n

throughout his life. No provision is made for future
\nattendant charges. In those circumstances, we
\nproper to award a sum of Rs.2
\naforesaid head as minimum of
\nto be paid for attending him.\n<\/p>\n
