2. The appellants\/ have  suit’<\/p>\n
for the relief of Spe.e_i\ufb01c_rl’perforrn’anee ldireeting the
\ndefendant to transfer,  property in
\nhis favour by ‘e\u00e9jgeleuting {thee abso-1ute__:sale deed or in the<\/p>\n
alternativetojdireet  to refund ? 12 lakhs<\/p>\n
together the rate of 24% per annum<\/p>\n

4. It is the case of the plaintiff that initially the<\/p>\n
suit was filed by Sri B.N.Nanjundappa <\/p>\n
death. his 1,123., are brought on record.<\/p>\n

being a Director of Messgrs.  Private Limited,

plaintiff. llgjagreernent of sale came into<\/p>\n
existeln.ce*on and the same was registered in<\/p>\n
the office”li:helS1ib–Registra.r. Bangalore. Out of ? 15<\/p>\n
   1al{l’1s..___was paid by the defendant. It was<\/p>\n
 eedv.tha’tt.:tl1–e transaction has to be completed on or<\/p>\n
before  Though the plaintiff was ready and<\/p>\n
willing\ufb02tol pay the balance sale consideration the<\/p>\n
 defe’n.dant never cowoperated in completing the sale<\/p>\n
 deed. On 31.03.1998, the defendant never appeared<\/p>\n
(V.\n<\/p>\n
before the Sub–Registrar to execute the sale deed in<\/p>\n
favour of plaintiff. Pursuant to the legal notice’–issi:j’e’d<\/p>\n
on 27.02.1998 calling upon the defendant<\/p>\n

\ncontract    direct the defendant to
\nrepaygrnenti’   with 24% interest per

. _6. “Tlie.drefe’11dant contested the suit. According<\/p>\n
”  gtO’_._\ufb01irnt,: there ilsfnotvagreernent of sale. The defendant<\/p>\n
 :had*  one Sri M.G.Hegde for a financial<\/p>\n
accornrnodation of 3 12 lakhs. The said M.G.Hegde in-<\/p>\n
 gtugrnu  securing the documents of the defendant got<\/p>\n
 –..gVthe..tA’tagreernent registered on 02.05.1997 and that the<\/p>\n

defendant did not receive any money from him except a<\/p>\n
sum of \u20ac75,000\/– which was paid by <\/p>\n
means of a cheque which in turn was  encashed. <\/p>\n
Therefore, contending that ftfie'-\u00ab .  '–were<\/p>\n
executed in order to secure loan from Mv._3G;'}\u00a7egde;'–~<\/p>\n
contended that the suit fiiedrby the  note<\/p>\n

  dated 19.11.2003 the present appeal is fiied.<\/p>\n

11. Though several grounds are urged by the<\/p>\n
appellants \/plaintiffs at the time of the argumer:1t;\ufb02’iVt”‘is<\/p>\n
the specific contention of the appellant that  <\/p>\n
court has erred in dismissing the ‘s!iit”_.of <\/p>\n
even though the defendanthad <\/p>\n
of the agreement. Accordinlg-to hi1n,_’  the if<\/p>\n
suit documents has been  thelexecution of
\nthe said documents Vlfaz:ln_3itted by the
\ndefendant,    an error in
\nignoring     “defendant during the
\ntrial. :7’31j1:’e;  the trial court has
\nconimitted’-an  the issues based on the<\/p>\n
pleadings of theep’artiesTand in the alternative, even if it<\/p>\n
. l”-Wpas ca?loai1..Atransaction, the trial Court ought to have<\/p>\n
  in favour of the appellant for refund of<\/p>\n
 arnourntff of \u20ac12 Iakhs which was paid to the<\/p>\n
defendant. It is further case that since there is clear<\/p>\n

 -\u00bb-the trial Court has failed to appreciate the said<\/p>\n
\u00abK\u00bb<\/p>\n

evidence. Hence, he requests the Court to set aside the<\/p>\n
judgment and decree of trial Court.<\/p>\n

by the defendant, the defendant has dispLttegd\u00ab._.’_lthe<\/p>\n
execution of the registered agreement of. <\/p>\n
contends that the documents of the ,p4rope.rty” \u00bbduestio’n if if<\/p>\n
were handed over to M.G.Hegde:”to <\/p>\n
advance a loan of 3. to  ‘defendant.”‘l<\/p>\n
According to him, the   ? 30
\nlakhs. On the  that amount of
\n?\u00b0 12 lakhs .vwou1_d ‘time and the
\ndefendant    ?. 75,000\/- as

\ndishonxo–uured.V  him, the defendant signed<\/p>\n
the documeiiotivpreparedwv the plaintiff and handed over<\/p>\n

 “lofan_}~to be arranged. According to him, there<\/p>\n
isno p_ri’vi_t\u00a7r of contract and that the documents given<\/p>\n
 M.G.Hegde has been misused by the plaintiff.<\/p>\n
 r’1g’h–e retrial Court considering the above pleadings has<\/p>\n

failed to frame an issue based on the pleadings of the<\/p>\n
defendant that whether the defendant proved<\/p>\n
documents of title were handed to M.G.Hegde <\/p>\n
to secure a loan of Q’. 12 lakhs_on__the_Vstrer1gth= ofgtlaell ”<\/p>\n
documents handed over to M.G.;’lvleg’de’lan:d. that <\/p>\n
documents were misused’lTbjra._lVI.G’;’Hegde’.’v.V_AA”5l:his. ‘issues’<\/p>\n
would arise based on. the ple-arVli’ngs~\u00bb..of the p.arties and in
\nView of the production oi”tlrefloriginal:docurnents of the<\/p>\n
property in quest–ion    <\/p>\n
   the trial Court having
\nconsiderued  of defendants EX.D.1 and<\/p>\n
Ex.L’.,43 andt’act- that the DW.1 has categorically in<\/p>\n
 his a.ci*oss”-egcamiriation admits about his putting the<\/p>\n
  E..x.p.4(a) and that he had been to the Sub-<\/p>\n
Registrarfjf\ufb01ce and put his thumb impression before<\/p>\n
 the \u00e9:’ub–Registrar and that he also admits that all<\/p>\n
“;_d’oeI:,1rnents pertaining to the property in question are<\/p>\n
 ”  Sri B.N.Nanjundappa, the original plaintiff, the<\/p>\n

plaintiff that he has proved the agreement in <\/p>\n
clear admission of DW.1 in his cross exaniiriations; “But <\/p>\n
unfortunately, this point has not been <\/p>\n
triai court.\n<\/p>\n

execution of documents byp..the..”defe-ndantf and-since the
\nburden of proof lies to prove that<\/p>\n
DW.1 exeeutedLE;\u00bbr.P.\u00e9}’   handed over to<\/p>\n
the originai  by the defendant in his d<\/p>\n
cross\u00a5exarninationp,’t thisp.”Court is of the view, that the<\/p>\n
trial Courtdhas’.fai1ed__’to frame proper issues on the<\/p>\n
  ba_.sis the afo’1″e.s_a_id pleadings. Therefore, we are of the<\/p>\n
‘  \u00abpoints that we have formulated above,<\/p>\n
requires ‘7’f’j_to’ be answered in favour of the<\/p>\n
 appellants\/plaintiffs and in View of the same, the<\/p>\n
 matters required to be reconsidered by the trial Court<\/p>\n
$1\/_<\/p>\n
afresh by framing appropriate issues and afford an<\/p>\n
opportunity to the parties.\n<\/p>\n
