Oza appearing with learned counsel,<br \/>\n\tMr.Rajesh Savjania for the applicant submitted that the<br \/>\n\tapplicant is not involved in the commission of crime and the<br \/>\n\tallegations are made with regard to irregularity in the payment on<br \/>\n\tthe basis of false vouchers and other evidence. However, it is<br \/>\n\tsubmitted that he is joined subsequently and therefore, the present<br \/>\n\tapplication may be allowed. He further submitted that<br \/>\n\the has been granted anticipatory bail as per the order passed in<br \/>\n\tCriminal Misc. Application No.11611 of 2010 and other co-accused has<br \/>\n\talso been granted anticipatory bail as per the order passed in<br \/>\n\tCriminal Misc. Application No.9537 of 2010 and therefore, the<br \/>\n\tpresent application may be allowed.\n<\/p>\n<p>\tLearned<br \/>\n\tA.P.P., Ms.Shah resisted the application and submitted that specific<br \/>\n\trole has been attributed. She has also submitted that though he has<br \/>\n\tjoined subsequently, there is a prima-facie case suggesting<br \/>\n\tinvolvement. Therefore, the present application may not be<br \/>\n\tentertained.\n<\/p>\n<p>\tHaving<br \/>\n\theard learned counsel appearing for the applicant-accused and<br \/>\n\tlearned A.P.P. for the State  and having considered the nature of<br \/>\n\toffence, role attributed as well as guidelines with regard to<br \/>\n\texercise of discretion under Section 438 of the Criminal Procedure<br \/>\n\tCode, the present application deserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tthe present application is allowed. The applicant is ordered to be<br \/>\n\treleased on bail in the event of his arrest in connection with<br \/>\n\tI-C.R.No.44\/2010 registered with Fathepura Police Station, District<br \/>\n\t: Dahod in respect of the offence alleged against him on his<br \/>\n\texecuting bond of Rs.5,000\/- (Rupees Five thousand only) with one<br \/>\n\tsolvent surety of the like amount, by him, by the concerned Police<br \/>\n\tOfficer and on conditions that he shall;\n<\/p>\n<p> a)\tremain present before the trial Court regularly as \tand when directed on the dates fixed;\n<\/p>\n<p>b)\tremain present at the concerned Police Station on 29.10.2010 between 11.00 a.m. and 2.00 p.m;\n<\/p>\n<p>c)\tmake himself available for interrogation by Police Officer, whenever and wherever required;\n<\/p>\n<p>d)\tnot directly or indirectly make any inducement, threat or promise to any person acquainted with the fact of the \tcase so as to dissuade him from disclosing such facts to the \tCourt or to any Police Officer;\n<\/p>\n<p>e)\tnot to obstruct or hamper the police investigation \tand not to play mischief with the evidence collected or yet to be collected by the police;\n<\/p>\n<p>f)\tat the time of execution of bond, furnish his address to the Investigating Officer and the Courts concerned, \tand shall not change his residence till the final disposal of the case or till further orders;\n<\/p>\n<p>g)\tnot leave India without the permission of the Court and if having Passport, shall deposit the same before the trial Court within a week;\n<\/p>\n<p>h)\tIt<br \/>\nshould be open to the Investigating Officer to file an application<br \/>\nfor remand if he considers it proper and just; and the learned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>\tThis<br \/>\n\torder will hold good if the applicant is arrested at any time within<br \/>\n\t90 days from today. The order for release on bail will remain<br \/>\n\toperative only for a period of ten days from the date of his arrest,<br \/>\n\tduring which it will be open to the applicant to make fresh<br \/>\n\tapplication for being enlarged on bail in usual course which when it<br \/>\n\tcomes before the competent Court, will be disposed of in accordance<br \/>\n\twith law, having regard to all the attending circumstances and the<br \/>\n\tmaterials available at the relevant time uninfluenced by the fact<br \/>\n\tthat anticipatory bail was granted.\n<\/p>\n<p>\tRule<br \/>\n\tis  made absolute to the aforesaid extent.
